The debate over how to sift out illegal voters from legal ones has reached the federal appeals court level, making it possible the Supreme Court eventually will rule whether a state can demand a birth certificate to register to vote.
The case before the 10th Circuit Court of Appeals in Denver centers on a 2011 Kansas law, the Documentary Proof of Citizenship (DPOC). In June, a district court judge struck down the law, with biting criticism of analysts who contend a large number of noncitizens nationwide vote illegally, tilting close elections to Democrats. Judge Julia A. Robinson said the Kansas legislation violated federal law and the 14th Amendment guarantee to equal protection.
The law, which requires proof of U.S. citizenship to register to vote, is vigorously defended by Kansas Secretary of State Kris Kobach, a nationally known Republican locked in a tight governors race. His own primary battle was so close the state attorney general cited it in a brief to the 10th Circuit as a race that could be influenced by illegal votes.
A backdrop is this: the U.S. count of noncitizens is growing. A Yale study says there may be twice as many immigrants living in the U.S. illegally 20 million than other analyses have found. That means the population of immigrants, most of whom are over 18, has reached 30 million. The U.S. has about 245 million residents 18 and older.
Amid Tuesdays elections for control of Congress, conservatives and liberals have starkly different views. The right say thousands break the law by voting, while liberal scholars say the count is so small as to be statistically zero.

There’s no right to vote. Those amendments just state that you can’t discriminate on sex, race or age(18)
The 14th Amendment does not guarantee that illegals can vote.
Because, to the left, if you’re a citizen, you suck. You are old, probably remember a time when it was applauded that you think for yourself. Now, that’s grossly undesirable.
A passport and a drivers license both require proof of citizenship, which is usually accomplished via a birth certificate.

The state of Arkansas scanned my passport and other documents into the database and asked me about voter registration.
Since this is not the EU, I think requiring a BC to vote or obtain a DL is a bit much like ‘presenting papers’. The BC being a very private document and so subject to supreme identity theft. Not to mention, forcing everyone to jump through yet another privacy invasion hoop is an insult to legacy Americans. And, what about hetero women? We get married and divorced and married again - so our BC name is not going to match our DL name or our SSN name.
A better solution, that does not demean-the-whole, is to remove the illegals, yes, all 20 million of the line-jumpers, and limit immigration from this point forward to those who have applied through the legal process, giving priority to those who’ve waited over 5 years. Otherwise, we’re just avoiding the problem at the core, which means the problem will increase, instead of solving the problem and ending an issue.

Are you saying that a person only needs to get a few people to swear that a random person was born in the USA and they can get a genuine birth certificate?
Yes, the amendments are part of the Constitution. No, there is no constitutional right to vote.

Wait a minute, you said a random person and I don’t know what you consider a random person.
Both his parents were citizens though had already passed and all his relatives were citizens, all born and raised in the US.
The fact that you have 3 separate amendments prohibiting discrimination on race, sex and age for the voting process implies there is no explicit right to vote. Just because it is referenced in the various amendments doesn’t mean anything. There is no declaration of a ‘right to vote’. That this ‘right to vote’ shall not be infringed.
Because the liberal analysts are lying. Illegals vote in droves and having to show id thwarts that somewhat.
Could I grab a few random people off the street, pay them fifty bucks for them to swear that I am a U.S. citizen and obtain a birth certificate?

I agree. But that shouldn’t mean that only BC is acceptable. Why not other documents, such as a US passport.
