Touching someone is not battery. It is no wonder this woman is on The View as opposed to practicing law. She sucks at it.

the crime or tort of unconsented physical contact with another person, even where the contact is not violent but merely menacing or offensive.

Touching someone without their consent sure as hell IS battery.
