DENVER He won his six-year legal battle over his refusal to create a gay wedding cake, but Christian baker Jack Phillips is now facing what could be a lengthy courtroom sequel on the issue of transgender birthday cakes.
Any hope of a speedy resolution was dashed Tuesday when a federal judge indicated he plans to reject the effort to dismiss the Colorado Civil Rights Commissions latest complaint against Masterpiece Cakeshop involving a birthday cake for a gender transition.
Im inclined to deny the motion to dismiss, said senior U.S. District Court Judge Wiley Y. Daniel.
He also advised Mr. Phillipss attorneys to narrow the scope of their request for a temporary injunction and prepare for an evidentiary hearing on the matter in February, which could last several days.
I dont think I have enough information to rule on this request for injunctive relief, Mr. Daniel said.
Alliance Defending Freedom senior counsel Jim Campbell, who represented Mr. Phillips at the hearing, said it was possible the case known as Masterpiece II could reach the Supreme Court, which ruled against the state in June, citing the commissions hostility toward the bakers beliefs.
What we have is the state of Colorado blatantly ignoring key portions of what the Supreme Court just said to them, Mr. Campbell said. The Supreme Court might not take very kindly to that, and so it very well might end up at the nations highest court again.
He referred to the situation as an obvious setup....

Seems like double jeopardy to me. It’s essentially the same case the baker already won.
I agree, the only difference is a wedding cake for a gay couple and a birthday cake for a tranny, it’s harassment in my view.

Houston’s so-called “bathroom bill” ran on for 30 pages and had such an un-elected panel in the works.

Because of Anthony Kennedy, the last SCOTUS ruling on this was incredibly narrow, and made it inevitable that this Baker would be charged again. Hopefully, the replacement of Kennedy by Kavanaugh will lead to a better opinion.

The District judge is an imbecile. The SCOTUS rational for allowing the Christian baker to refuse to accommodate the gay couple would certainly transitionally apply to the same baker refusing to bake a cake for a transgender individual because of his religious conviction.
And btw, stinks to high heaven of a “setup”. The judge as well as the CCRC ought to be severely sanctioned.

When the courts fail to deliver on their responsibility to protect our fundamental, God-given rights, it is our responsibility as citizens to ensure that justice is served.
It’s absusive. Leave the man alone to live his life the way he wants, just like others want to live their lives the way they want. Of course this is a set-up - they went right back to the same baker to harass him for basically the same issue, with a slight twist of pretext. It’s unethical, abusive, just wrong. And personally I don’t care what people want to do to their own bodies, call themselves whatever they want, wear any clothes they want - just let everyone else enjoy the same. Trangender, straight, gay, bi, swingers, adulterers, virgins etc all have the same right to their beliefs and freedom from coercive action contrary to their will.
And I don’t even know why this is still being argued. I don’t know why it was argued in the first place. Mohammed Ali was granted concientious objector status to the Vietnam War in a UNANIMOUS Supreme Court ruling. If you can conscientiously object to being drafted, you sure has heck should be able to consceintiously object to baking a cake!
The worst of it is that this is just “you can’t fight city hall” type crap. They don’t care it’s not their time or money - they will intimidate and coerce people without care what it does to their lives. Until there are severe penalties paid by those who abuse their power these things will never change.
Congress should change the sovereign immunity laws. Time to force agents of the government to think twice about civil rights violations.
It won’t be too much longer before they burn us in ovens.
