Why don’t they arrest these people when the buy is being done?
With all the states at least legalizing medical marijuana why bother for someone who is small time seller?
Especially if the result is a loss of a police officer life?
It is just not worth the price.

The complaint says that officers surrounded the residence near 12th Street and Manitoba, and yelled Police, search warrant as the approached the door and started to break it down. Officer Rittner was the officer operating the ram who was breaking down the door.
This sounds like a plan designed to get a police officer shot - approach a person's residence, yell and start breaking down the door. What exactly is the person inside supposed to think or do?

Sounds as though Fricke did not clearly identify his target prior to opening fire. Regardless of whatever else is uncovered regarding illegal activity or lack thereof, hes in for a bad time.
Equipment used in drug sales is incredibly vague to my mind. My guess is if police hadnt broken down the door (although from the sounds of things they did identify themselves as law enforcement and Fricke attested to that) or if Fricke hadnt shot at he knew not what, he would have been fine after the search turned up nothing illegal (apparently).
Result is a catch-22. Police will say they chose to use a no-knock warrant because Fricke was potentially dangerous, and the fact that he killed a police officer validates that claim. On the other hand Fricke will no doubt say that if they didnt use a no-knock warrant he wouldnt have shot anyone.

I am sorry, but the police bring this on themselves. There was no need to kick the door in. They did it to get their jollies off. In WI they have also done it at the behest of the prosecutor for political intimidation.
I think the procedure to get a search warrant needs to also address the methods used. Maybe judges can bring some sanity to this madness.

No knock warrants are a double edged sword in cause and effect. The concept is to make a safer entry for the officers by using the element of surprise. This element of surprise is not always a good thing and can backfire killing people instead. The concept is irrational.

This guy shouldn't be charged with anything. If they had killed him in his bed we wouldn't even be hearing about it. They get away with irresponsible actions all the time. It was law enforcement that decided to take ridiculously aggressive actions for a minor offense. They should be the ones facing charges for unnecessarily creating the situation. A lot of people are going to go for their gun when they are suddenly put into a confusing situation where seconds matter. It's usually the cops who do the killing though. These raids should only be used for serious crimes where there is actually a reason to believe the person will violently resist under other circumstances.

It’s the David Koresh protocol. Why didn’t the LEOs simply wait for Fricke to leave the house and arrest him then? If they had a warrant they had no need to break in to the house. Plenty of stupid to go around on this one.
