Rand Paul Is Right to Reject Trump’s Emergency Declaration

Senator Rand Paul has announced that, despite supporting improvements in border security, he will vote against President Trump’s emergency declaration on the grounds that it’s an abuse of executive power — and he’s absolutely right.

“Every single Republican I know decried President Obama’s use of executive power to legislate,” Paul wrote in an opinion piece for Fox News. “We were right then.”

Abuse of executive power? How does that work exactly?

The POTUS enforces the law and he’s commander in chief of our armed forces in charge of national security. It’s the definition of executive power under the Constitution.

I’d buy into this argument if congress ever stopped any other States of emergencies or even “Presidental over reach”. If the invasion of the country isn’t an “emergency” I’m not sure what would be. Hopefully Rand Paul loses next election as this is either a) Grandstanding to get on tv or B) he is getting money from Cheap Labor Express.

Navel gazing to determine the intent of the constitution is an intellectual exercise which ignores the reality on the ground.

The reason being given is BS. The Congress passed a law giving Trump the authority to do what he is doing. People like Rand Paul don’t like the gov’t doing anything and he is using his vote to make his point. Obama on the other hand did not have laws or the Constitution to back up his EOs for the most part. This is just more weak kneed Republican’s trying to wrap up their patheticness in separation of powers and power of the purse arguments.

If abuse of power is REALLY what Rand is wee-weed up about, let the a$$hat led the charge to repeal the emergency powers law; otherwise, he is behaving like a hypocrite that that is on the take.

The law NEA 1976 also allows the congress to terminate the declaration. The president can veto. The congress can override or not.

And was an abuse of power then. If anything looking at the uses since then confirms it. Except for Trumps declaration, only because it’s a real emergency and Congress isn’t doing its job.

I think that’s probably true for all but Rand Paul.

Paul is a purist; the power of the purse is given to Congress, so this statute is on tenuous Constitutional footing (in thi s circumstance) is his purist argument. He would require something like a nuclear war, not something we’ve been living with since Ted Kennedy opened our borders wide.

Rand’s position is not irrational; I just disagree with the Rand on whether this is an emergency.

I, like you, think it is.
