It doesn’t have to be deliberate to be prosecutable. Recall the navy guy who took a selfie on a sub and went to prison.
I am so tired of the dual “justice” system.

The federal has definitely way too much power. There should be convention of state with law enforcement powers in situations like these
By the way, what happened to that? Trump is no shield in this

IT-wise, using a home-brew email system to circumvent every security and compliance protocol is as bad as you can get.
Any of us plebs that did that would spend decades in a federal pound-me-in-the-ass prison. Miss Haversham will get a letter in her file.
Pretty blatant

Is this using Comey’s extra-legal standard of “intent” as a benchmark?

So setting up a private and SECRET email server in order to avoid any FOI requests or investigations was AOK! Got it. And the Bleach Bit and hammers was all kosher too! What a country!

concluded there was no systemic or deliberate mishandling of classified information Well isn't that special.
The State Dept is investigating itself.

This is sooo bull manure. The applicable statute is discussed at this link. Section 793(f) of the federal penal code (Title 18), criminalizes gross negligence thereby rendering intention irrelevant.
FBI Rewrites Federal Law to Let Hillary Off the Hook http://www.nationalreview.com/corner/437479/fbi-rewrites-federal-law-let-hillary-hook
The same applies to the UCMJ. Our Communications Officer received so many admonitions about negligence at Registered Publications School that they all decided Fort Leavenworth Prison was the best place to hold class reunions.
