Hillary Clinton ‘intimidated’ by Tulsi Gabbard's $50M lawsuit, won’t accept legal documents, lawyer claims: report

Hillary Clinton or her representatives have, on at least two occasions, declined to accept legal papers delivered in connection with Tulsi Gabbard’s lawsuit against her, Gabbard’s attorney claims.

Gabbard, a Democratic congresswoman from Hawaii who is seeking the party's 2020 presidential nomination, filed a $50 million lawsuit against Clinton last week over the former secretary of state’s insinuation that Gabbard was a “Russian asset.”

Brian Dunne, an attorney representing Gabbard, told the New York Post that Secret Service agents turned away a process server Tuesday when the server tried to deliver the lawsuit to Clinton’s home in Chappaqua, N.Y., north of New York City.

I’m no fan of Tulsi Gabbard’s Leftist views however let me say these three things:

1) Seth Rich
2) Shawn Lucas, after delivering papers to the DNC
3) John Ashe

The Secret Service agent is an agent of the government with police powers so he could sign/accept the document from a legally certified process server.

Time to haul the agent’s ass before a court or congressional committee, put him under oath, and ask/demand to know why he refused to accept a legally served document.

The same for the Director of the Secret Service and the person who heads the Secret Service detail protecting Hillary.

That would be quite a show of 5th Amendment claims, I don’t recall lines, and “it wasn’t my responsibility but I don’t know whose it is and who gave the order”.

As Pres. Trump could say to them, “You’re Fired”!!

I don’t know the rules for Federal courts but under California law I could have, (1980’s-1990’s), gotten the name of one of the guards/officers and done a substitution of service on that person. I then would be required to send a copy by mail, with a “do not forward” notice on the envelope. My affidavit of service would identify the person I served by name and a physical description and the reason that I did a substituted service.

Members of the Bar don’t get to ‘decline legal papers’.

Hillary can try to dodge service till the cows come home, but her attorneys can’t.

And, there are other means to serve a reluctant defendant than via personal service.

Maybe if I read this, it will make some kind of sense.

Hillary can now be considered lawfully served.

Publication in via a high profile news network is more than sufficient to satisfy the requirements of reasonable notice to defendants.

It’s hard to imagine members of the Bar doing sillier things than trying to ‘refuse’ service. It’s an option they don’t have, as officers of the court.

Wouldn’t Tulsi Gabbard’s lawyers know that? If you are right and Hillary is considered lawfully served then what is the point of the article?

Secret Service turned away the process server?

Sounds like a bit of an overreach... Those folks are on the taxpayers’ dime, not Killery’s. Their mandate is to secure her safety, not her comfort.

you have to prove that the person refused the process server’s documents....this only delays things which tells me hillery tactic will be to make everything as expensive to do as possible in hopes that the suit is abandoned.

Right. But they didn't. This is a Clinton pattern - stonewall and test the legal process. All along they way they find chances to escape.

There are methods that can be used to demonstrate service when somebody is clearly avoiding it deliberately. This is a pointless exercise.

Hillary is immune to these methods. She will not be held accountable.

It is a pointless exercise to get Hillary to do anything she doesn't want to do. She will find a way to get out of it, and they will continue to let her.
