Walmart sued by family of worker killed by coronavirus

Two Walmart grocery store employees and a greeter at a Giant store are among at least four supermarket workers who have died from the coronavirus in the U.S.

A Walmart spokesperson confirmed to NBC News on Tuesday that two workers at a Chicago-area store died after contracting the virus.

"We are heartbroken at the passing of two associates at our Evergreen Park store and we are mourning along with their families," the company said in a statement.

The employees were identified in a wrongful death lawsuit filed against the company as Wando Evans, 51, and Phillip Thomas, 48.

Evans' brother, Toney Evans, filed the suit against Walmart Inc. on Monday in a Cook County Circuit Court, claiming willful and wanton misconduct, reckless disregard and gross negligence.

The suit alleges that managers at the store in Evergreen Park, about 17 miles southwest of downtown Chicago, failed to alert workers after several employees began showing symptoms of COVID-19, the disease caused by the virus.

Walmart "had a duty to exercise reasonable care in keeping the store in a safe and healthy environment and, in particular, to protect employees, customers and other individuals within the store from contracting COVID-19 when it knew or should have known that individuals at the store were at a very high risk of infection and exposure," the lawsuit states.

Wando Evans, an overnight stock and maintenance associate, first began experiencing symptoms in mid-March and told a store manager, "but was ignored," the brother's attorney, Tony Kalogerakos, said in a press release.

On March 23, the 51-year-old was sent home from work. Two days later he was found dead in his home.

Sounds like a possible worker’s compensation claim. There is Civil immunity for employers.

I new the slip and fall lawyers would love the virus...just a matter of time

No business is safe now..

Did they confirm it was the virus or just assume..

A greeter at a Giant Food Stores in Largo, Maryland, also died from the coronavirus. The Washington Post identified the worker as Leilani Jordan, 27.

Daniel Wolk, a spokesman for the food chain, said in a statement that the company was told by the worker’s family on Thursday that she had died.

“We can only imagine the heartache they are experiencing and have offered our support during this difficult time,” he said.

Medical professionals have (rightfully) recently gotten a lot of heartfelt praise for their dedication to their duties, at great personal risk.

The blue (and pink) collar workers, who keep the supply chains intact, and keep our vital public utilities (esp. water and electricity) working deserve the same respect and thanks. Without them, things would completely fall apart, and quickly.

I wrote most of my MBA papers on Walmart. They publish all their corporate data, whereas most companies do not. At the time, around 2006, I read they were being sued some 500 times per day worldwide. They had more lawyers on staff than the next ten companies combined. Their general response at the time was to fight every lawsuit to the hilt.

If they had a, say, $5000 payout to settle nuisance suits, like many companies do, then they would see thousands of lawsuits per day. I suspect that they manage to run the opposing side into high bills or unpaid time so much that most suits get dropped. That is how I won a lawsuit. I bankrupted the other party. (Or, rather their law firm sucked them dry, as my lawyer said they would.)

If that’s true, then Walmart is at fault. If there is a danger at a worksite, the employees have a right to know about it. Secrecy is rarely a good thing.

Good luck proving they even contracted it at Walmart much less being able to prove Walmart negligence. Just looking for thei ticket.

I DO feel sorry for the Walmart workers. I have been lucky with ordering online and picking up...haven’t set foot in any store since Friday the 13th (March). The Walmart workers who bring out my order are young, wear masks and gloves, are very friendly and move fast. I always give them a generous tip.

I worry about the workers in the store, tho, and my hat goes off to any person in the line of the beast. Glad that Walmart is cutting back on the number of shoppers entering the store at the same time. Hope that makes a difference.

I think it would be easy to prove Walmart’s negligence (or innocence). If an employee told a manager that he (the employee) had virus symptoms, those folks who worked near that employee should have been notified.

Just tell the truth. The employee had symptoms. That doesn’t mean he has the virus. Maybe he just has a cold. But don’t keep anything secret. Let the other employees know, then let them decide for themselves what to do next.

Gee - what a surprise. Attorneys sure do get around, don’t they AND FAST? More lurking and waiting going on all over the country. They should be arrested and charged as “stalkers.”
