The US Constitution grants *every* US citizen,regardless of where he/she lives,certain rights. And the President has the power...actually,the duty...to ensure that those rights are respected.

And unless I'm *very* much mistaken one of those rights is the right to leave one's own home.

They should have to suffer but i doubt they will. For the next 4 month they will get a government funded vacation.
Then after that probably more “stimulus”

Cuomo is taking the bait, and he doesn’t even realize it.

The hook is all the way down his gullet. When the other states open up and his own people start driving a hundred miles each way to spend their money in other states, or are still trapped at home in NY while the rest of America thrives, it will be then end of his political career.

The bad news is that New Yorkers, having tasted Freedom, might move to those saner states and begin infecting them with the very leftist voting practices that made NY a commie swamp to begin with.

Trump is right. The federal government’s findings and declaration of emergency provide the factual and legal basis for the various state and local declarations of emergency issued in reliance on them. If the federal government issues new findings and declares the national emergency over in whole or in part, the state and local declarations are no longer sustainable and have to be terminated or revised to meet the terms of the new federal findings and declaration. If not, the original unrevised and noncompliant state and local declarations and orders to the public become vulnerable to court challenge.

Cuomo needs to dust off the Constitution and read it again. The Founders gave a President an unprecidented level of power when a National Emergency is deemed necessary. Trump rules, al-be-it a
temporary power. They also gave us the 2nd. Amendment to ensure that power is not abused. They were brilliant. Cuomo, not so much.

The truth is the US is under a state of emergency a President has special powers and authorities when the US is in a state of declared emergency. As VP Pence said, all 50 states Governors have declared emergencies in their states and the President has declared a national emergency. I think the last time this happened was during WWII. So yes the President, no matter whom occupies the office has ultimate authority, in this case, to make decisions about what we do as a nation vis-a-vis the coronavirus.

Well, here’s another point of view. Cuomo KNOWS this, but the idiots that vote the liberal ticket (or I should say anti-Trump ticket) do not have a clue. They will jump on that bandwagon full of Trump rage. Cuomo knows this, but so does Trump who is way smarter.

These Hair on Fire partisans are completely missing the fact that when the president declares a national emergency, AS HE HAS DONE IN ALL 50 STATES AND THE TERRITORIES, he, alone, has the authority to lift it, as well. He was not declaring his authority over all US citizens for all things and all time, he was simply stating the powers of any president in a declared national emergency.

Additionally, no government bureaucrat, appointed or elected, has the power to, for instance, prohibit flag sales and garden seed sales, as Governor Half-Whitt of Michigan has, nor to fine members of a church for listening to their pastor by radio while staying in their cars, meeting all declared “Social Distancing” guidelines.

There is a US Constitution, and there are US Laws, and the President is meeting all of them. Many Swamp Bureaucrats are not.

I’d like to see this go back to the USSC for another look as when the decision that was made to place so much of the nations business under the commerce clause so haphazardly it was made by a highly partisan liberal court whose reasoning was flawed at best IMO so I’d like to see a conservative court take another look at that decision and hopefully set things right once again and return these powers back to the states where they rightfully belong and were for 200 years.

There’s no real conflict here. You just have to understand how Trump speaks. He talks in practical terms, not theoretically. It is true theoretically that the governors have the power to reopen state economies. However if and when Trump releases guidelines allilowing resumption of most economic activity, at least half the states will reopen. The usual suspects (Cuomo in NY, Newsome in CA, Wolf in PA etc) will balk. Those who balk will see their states fall behind economically and will see their approval ratings plummet. They will feel enormous pressure to reopen and will eventually cave. The practical effect will be that Trump made the call to reopen.
