Furthermore, a defense attorney cannot BLOCK his client from testifying for himself period. If he wants to testify he has that right.

In the defense opening argument, Rittenhouse’s legal team told the jury that they’d be hearing from the defendant. If they didn’t put him up there then the defense team might think the jury will count it against him.

Prosecutor’s line of questioning was suggesting that Kyle kept quiet until the trial so he could tailor his testimony to what was presented in court. Judge ruled that using that line of questioning was denying Kyle his 5th amendment rights and therefore unconstitutional.

Obviously the focus is on the murder charge, but Rittenhouse is also charged with a weapons violation that could bring a 5-year sentence.

This is one area that isn’t the defense’s call. They can counsel him not to testify, but they have absolutely no way to stop him from taking the stand if he wants to.

I think the judge needs to stop the prosecutor from going down this road about the gun laws and possessing/using the gun.

Because the DA just wants to perpetuate the ASSAULT RIFLE theme.

BINGO!!
The media has been painting Kyle as a far right, nut case, cold blooded killer. Now the jury gets to meet the REAL Kyle Rittenhouse. A grounded, community minded, compassionate young man still emotionally jarred by the deaths of two men who attacked him, requiring him to use deadly force to save his own life.
The bumbling prosection badgered at least one of their own witnesses. If he bashes Kyle the jury will react by giving more credence to Kyle’s testimony.
If Kyle successfully holds up under prosecution badgering then the defense handed the jury the golden ticket they needed for a not guilty verdict.

Had a curfew violation charge too. That was dismissed on defense motion yesterday because the state didn’t put on enough evidence.

Yes, because once you assert self defense as your affirmative defense, the defense has to provide some proof of self defense that the prosecution has to then disprove beyond a reasonable doubt. That is why a defendant testifies in many, not all, self defense cases. If you have a clean defendant, meaning no prior convictions, that is articulate like this young man, that can testify to his state of mind when it happened which is critical, you have to consider putting him on the stand.

They have a way: persuasion. A lot of people are in jail because they didn’t listen to their attorneys.
