WASHINGTON (AP) — Senate Democrats who have played defense for the last three Supreme Court vacancies plan to move swiftly to replace retiring Supreme Court Justice Stephen Breyer, using the rapid 2020 confirmation of Justice Amy Coney Barrett as a new standard.
Barrett was confirmed exactly a month after then-President Donald Trump nominated her to replace the late Justice Ruth Bader Ginsburg — and just five weeks after Ginsburg’s death in September of that year. Democrats sharply criticized that timeline then, arguing that most confirmations had taken much longer and that Republicans were trying to jam the nomination through in case Trump lost reelection.
But now that they hold the presidency and the Senate, though just barely, Democrats navigating the complicated politics of a 50-50 chamber are eyeing a similarly swift schedule, even if Breyer does not officially step down until the summer.
The Senate plans to launch the confirmation process as soon as Biden makes the nomination, regardless of when Breyer officially steps away, according to a Senate aide who was not authorized to publicly discuss the planning and spoke on condition of anonymity.
Democrats could quickly hold committee hearings and even a full vote in the Senate before Breyer steps down, the aide said. The Senate would just refrain from sending the president the paperwork on the final confirmation vote until Breyer has retired.

Until I hear something from Breyer publicly, I wouldn’t put it past the Dem/MSM operation to announce that Breyer is leaving and dare him to publicly contradict them by denying that he is retiring.
I’m not claiming Breyer is not retiring, I’m just saying in this age of rigged elections, brazen MSM propaganda, big tech censorship and politicized justice, we can’t assume anything to be off the table.

Is it time to recruit a school mate of the nominee who will make unsubstantiated claims of some illegal activity in order to smear the nominee? And will we get tickets to the confirmation so we can protest and “shut down“ the committee for a while like the Democrats always do. In the novel and movie Advise and Consent the President dies at the very moment the VP in charge of the Senate has counted the votes to be a tie. Now that he is President instead of VP, he can't cast the tie breaker but wants his own nominee anyway.

Biden will nominate, and the Senate will approve, Judge Ketanji Brown Jackson. You can take it to the bank.
I would argue that it is a political mistake to “let the nominee just go through” for several reasons:
1. The Republicans must show that they are willing and able to fight just as hard as the Democrats on every issue. The base needs to see this and not the usual rollover, spineless act;
2. By fighting hard against the nominee, they are staking out the price to be paid for radical nominations which might make a future Democrat President show some restraint in choosing picks (fuggedabout Biden his handlers will always make the most radical picks);
3. It is worthwhile to expose the nominee’s record to the public for purposes of diminishing their reputations and making them think twice about confirming the worst charges against them in their own decisions and choices.
