“ Even if it is legal, it surely must go against what the founding fathers intended. I don’t see how the Senate can simply hold judgeships in reserve and play them like a Trump card. ”

They would be too frightened to go a day with one less lefty on the court.

The Biden regime is saying he has told them that he is resigning effective the end of the term.

Merrick is far more dangerous where he is now. No controlling authority over him. See The Obama years.

This is not a wash.

The Dems are going to put a 30-something communist in there. They want someone as young as possible to be a bench tyrant for the Left for 50 years.

This is why Merrick Garland and Killary or even Obama will not be considered for the seat.

And she'll be utterly ignorant, loud, and proud of it. Sheila Jackson levels of stubris.

Until I hear something from Breyer publicly, I wouldn’t put it past the Dem/MSM operation to announce that Breyer is leaving and dare him to publicly contradict them by denying that he is retiring.

I’m not claiming Breyer is not retiring, I’m just saying in this age of rigged elections, brazen MSM propaganda, big tech censorship and politicized justice, we can’t assume anything to be off the table.

A Trump pick would have sent the Left into paroxysms since it would further tilt the court towards rationality.

“Has Breyer actually said he is retiring, or is this the MSM/Dem borg trying to pressure and stampede Breyer into stepping down?”

NO, Breyer has NOT officially announced his retirement, and word is he is PO’d that they are saying he will do so.

I hope he stays just for spite. He’s small enough to do just that.

Is it time to recruit a school mate of the nominee who will make unsubstantiated claims of some illegal activity in order to smear the nominee? And will we get tickets to the confirmation so we can protest and “shut down“ the committee for a while like the Democrats always do. Of course I’m just asking for a friend cause they don’t use the Internet and I have to type out all the questions for them on the Internet and get answers.

Since replacing Breyer won’t change the balance of the court, and since there is no chance in hell that Biden will ever send the Senate a decent pick, why bother mustering the resources to fight it? Just let it go through and fight elsewhere.

That's not what Dems do, and that's why they keep winning. They fight for every inch.

Yeah, we will not get a conservative justice, but at least we could go for getting a non-Marxist.

I will surprised if Sniffer does not nominate the Ho. I wonder if they would make Kamala (President of the Senate) step down while the Senate reviews her for a SCOTUS seat? Then, once she gets rejected, the Dems can choose another judge and another VP?

Interesting complication.

In the novel and movie Advise and Consent the President dies at the very moment the VP in charge of the Senate has counted the votes to be a tie. Now that he is President instead of VP, he can't cast the tie breaker but wants his own nominee anyway.

Part of synopsis:

Meanwhile, Van Ackerman sics a team of blackmailers on Anderson in an attempt to ensure the nomination, even though Anderson, Munson, and the president know Leffingwell has provided perjured testimony about his past. Anderson travels to New York and confronts his old army lover outside a gay bar, returning to the Capitol to slit his own throat in his Senate office. Chastened by Anderson's suicide, Munson and Cooley agree to disagree in a "nice" way, and the full Senate vote on Leffingwell's nomination ends on a 47-47 tie since Munson has shamed Van Ackerman into walking out of the chamber before his name is called to vote. Just as the voting ends, the Vice-president Harley Hudson, the Senate's presiding officer, is informed of the President's death. Knowing that Leffingwell has given false testimony under oath, Hudson refuses to honor his mentor's dying wish, and cast the deciding vote. Hudson leaves stating that as president-apparent, he'll nominate his own Secretary of State.

Must be a young black woman.

Biden will nominate, and the Senate will approve, Judge Ketanji Brown Jackson. You can take it to the bank.

I would argue that it is a political mistake to “let the nominee just go through” for several reasons:

1. The Republicans must show that they are willing and able to fight just as hard as the Democrats on every issue. The base needs to see this and not the usual rollover, spineless act;
2. By fighting hard against the nominee, they are staking out the price to be paid for radical nominations which might make a future Democrat President show some restraint in choosing picks (fuggedabout Biden his handlers will always make the most radical picks);
3. It is worthwhile to expose the nominee’s record to the public for purposes of diminishing their reputations and making them think twice about confirming the worst charges against them in their own decisions and choices.
