Joe Biden, as VP and Senator, was never authorized to keep any classified documents. Some were more than 40 years old.

1. Biden is guilty of intentional improper storage of classified information up to, and including, Top Secret but due to his impaired mental acuity, it isn’t feasible to prosecute him as no jury would convict.

2. Biden’s mental acuity is fine, he’s mentally sharp and therefore he’s qualified to be President for another 4 years.

You might be able to say he is senile and didn’t know about the recent records from his time as VPOTUS. Some of the classified material dates back to the 1980’s, yes that’s what 40 years old means, THE 1980’s.

When I dealt with controlled materials, they were checked out and (it never happened that I knew of) but if someone hadn’t checked them back in, serious consequences could occur. So serious in fact, that I kept my document receipts for about fourteen years. Not that I thought anyone would come for them, but the consequences were so serious it was just good insurance to have that piece of paper saying I’d turned them in.
The problem here appears to be that the people who check them out are so powerful that there are no possible consequences...unless they’re Republicans. Frankly, I don’t see any need for any politician to keep and maintain secret material. Once you no longer have the job that requires you to view this material, why would you still have it? This should include anyone. Also, why do some people who are no longer in a job requiring it able to access secret information? This happened several times for former Clinton employees. The only reason would be to sell that information.
