While I think you’re on the right track, I do see a bit of
a problem with your analogy. You may not agree, and that’s
okay. I think I can see an argument in rebuttal, but let
me run this buy you anyway.
IMO > this suit is taking the wrong party to task. It is
not the job of BK to enforce the civil laws of a township,
state, or federal government.
It conducts its business in the public arena. It is the
law enforcement agencies who are tasked with administering
“Law Enforcement”.
This suit should be thrown out because it is not the job
of BK to force citizens to abide by the law.
In your analogies, you touched on companies that might be
to blame for their products causing health or community
problems. This is not an area where a third party is
responsible, other than the end user of their products.
They were participating in legal activity, but their
products could be deemed problematic. They were not being
asked to be responsible for something that was not a task
they would normally not be required to do, such as “Law
Enforcement”.
If parties wanted to file a suit, I would direct them to
file it against agencies who have chosen not to enforce
the laws of our land. If they called the police and the
police refused to do their duty, then call them on it,
not BK.
In this instance, BK was not putting out product that was
the target of some “do-good” pie faces, like tobacco or
guns.
BK also has a right to conduct business in the public arena,
and is not responsible for what people do at the same time
in that same arena. It cannot be expected to simply pass
up on a reasoned effort, just because drug dealers decide
to corrupt the process. BK is not responsible for that.
I suspect this has more to do with killing businesses that
produce meat for public consumption, than it does with the
claimed drug dealers.
This is evidence of a full court press to take down any
business that serves meat, by any means possible.
