Mexico Threatens Drastic Action over Border Fence

Angry that six years of lobbying effort aimed at an immigration reform that would allow millions to cross into the United States legally, the Mexican government sent a diplomatic note to Washington criticizing the plan for 700 miles of new fencing along the border. Foreign Secretary Luis Ernesto Derbez called it an “offense” and said his office was considering suing the United States.

“We have an easement right to enter the United States,” Derbez said. “We will sue!”

An easement is the right of use over the real property of another. Another term for easement is equitable servitude. The right is often described as the right to use the land of another for a special purpose. Unlike a lease, an easement does not give the holder a right of “possession” of the property, only a right of use.

In most of the United States, using someone else’s property, for example, for ingress and egress over a certain number of years, regularly and without the consent of the property owner, can give the user the right to continue using the property for the same purpose for as long as the user wishes. This method of acquiring an easement is called a “prescriptive easement” or “easement by prescription.”

Derbez is rumored to have put out feelers to John Edwards to see if he will take the case.

Ruben Aguilar, spokesman for President Vicente Fox, said that Mexico had ruled out suing. He added he was “confident” the additional fencing would never be built because the vote on a fence was “just election-year posturing.” “They have to sound tough going into the election,” Aguilar said. “Polls show 80% of the voters want a fence. After the election is over the normal conditions will reassert themselves.”

President-elect Felipe Calderon echoed Derbez’s anger, but disagreed that a lawsuit was the right approach. “Free migration is a human right,” Calderon asserted. “We will tear down this wall if we have to.”

And easement to enter the U.S.?

Ummm...easement rights were designed for property owners to access another part of 'their' property that they wouldn't normally have access too.

Mexico has no 'property' in the U.S. or anywhere 'beyond' the Northern border which Mexico needs 'easement rights' too.

The problem is, they don't want to 'migrate' to somewhere else, passing through the U.S. They want to 'migrate' to the U.S. illegally.

There is no inherent right to do so. And they know it.

He's right. They can see through the smoke screen that Congress just laid for Americans! The fence will never be built.

They have nothing until a US court says they have something. The court action wouldn't properly be called a lawsuit.

Exactly. In fact, Mexico is to Guatemala approximately what the US is to Mexico: a much more prosperous country. And Mexico enforces its national sovereignty against Guatemalans much more forcefully than we enforce our national sovereignty against "undocumented" Mexicans.

The current sad state of affairs exists because of one of those occasional, unholy alliances between the right and the left. On the right--at least, the pro-business portion of it--are businessmen and Chamber of Commerce types who want an inexhaustable supply of cheap labor--no questions asked. On the left are the transnationalists--who, just by definition, believe in open (or better yet, nonexistent) borders; and those who believe that the current world order is unjust, and must be upset by any means necessary.

The anarchic mindset of some invaders (and that is what they are) can be seen clearly in their cherished motto: "We didn't cross the border. The border crossed us."

That was my point: our editorialists and politicians should explicitly challenge the Mexicans to remove all border posts from their Guatemalan border, reminding them that free migration is a human right and that we learned that principle from them. I wonder how they would respond.

Scam or sham, either way, they are planning on sticking it to Americans. This is how confident Mexico is that we will keep the border open. There's NO way they would still be having this conference if they thought the border fence was going to be put up. What's even more maddening is that countries other than Mexico are meeting with them to decide OUR future!!! This really makes my blood boil. There are so many traitors in our government it would take us a month to hang them all. ;o)
