The Second Amendment Is One Supreme Court Justice from Repeal

In August, my colleague Charlie Cooke wrote an epic rant daring the Left to stop talking about repealing the Second Amendment and start doing it. Introduce the repeal to Congress, work it through the states, and tell the American people what you want to do — take from them a fundamental, enumerated right from the Bill of Rights. As Charlie eloquently outlines, repealing the Second Amendment is an impossible task. Even worse for the Left, it’s political suicide.

But if the Supreme Court’s decision in Obergefell v. Hodges teaches us anything, it’s that the age of judicial supremacy means that five justices can amend the Constitution far more efficiently than Congress and the state legislatures. And right now there are clearly four Supreme Court justices who are committed to the absurd view that the operative clause of the Second Amendment — “the right of the people to keep and bear Arms, shall not be infringed” — doesn’t actually mean “the right of the people” and therefore doesn’t encompass an individual right to own a weapon, even for self-defense. This view defies history yet is received, conventional wisdom on the judicial Left, in much the same way that it’s received, conventional wisdom that the Constitution actually protects rights to abortion and gay marriage.

"clearly" ?

I follow the SCOTUS court ruling, not as close as I should, but I don't think it's "clear" at all...

That's a pretty big step for SCOTUS to make, stripping an actual amendment from the Bills of Rights, considering they don't want to be the cause of CWII and the death of many government goons and americans...

They can not repeal it, but what they can do, like the Red Queen in Alice in Wonderland, redefine words to mean what they want them to mean.

Thus they will interpret the 2nd Amendment to mean only the government agents can have guns. (Which goes against any understanding of the time when the amendment was written.)

The Constitution sole purpose as I understand it was to limit the power of the federal government. We are so far away from that concept it is not funny.

Somehow it has come about that the constitution limits the power of the citizens (think hate crimes and discrimination).

This article makes me very pessimistic.

The only thing standing between the right to bear assault weapons and tyranny is the health of the current conservative justices.

The only two Republican candidates capable of beating the Democratic nominee (Donald Trump and Ted Cruz) are getting attacked on a daily basis by the GOPe. And, as we know, there is no way a GOPe Senate (if they are somehow able to keep a majority in 2016) is going to reject a Democratic President’s Supreme Court nominees. In fact, I could easily see a 7-2 liberal majority by 2020.

I don’t know. There are many people who would willingly comply. I would certainly have to pray about it. On the one hand, I’m obliged to render unto Caesar. On the other, I believe I have a legitimate, God-given right of self defense.

The sad thing is we all know the Supreme Court of the United States is a rogue agency that is unconstitutionally and immorally amending the US Constitution. Every last judge that voted—an appropriate term—for gay marriage and Obamacare should be impeached for violating their oath of office. They swear to uphold the US Constitution, but they do anything but.

I agree. If you want to touch off CWII just let the SCOTUS try to re-interpret the 2nd Ammendment. I can’t speak for the North but the South is, was and always will be a gun culture and we will go berserk down here. Nobody wants to see that happen. Nobody down here is going to register a gun much less give it up.

I don’t think they would be stupid enough to go door to door and collect guns. What they would do instead is ban ammunition.

All we need is ONE EVENT, ONE CATASTROPHE, to PUSH IT ALL OVER THE EDGE.

They (the people in power) will either WAIT for it to occur naturally, or they will INSTIGATE it.

All these events recently really have me wondering if they haven’t already tried instigating it already and we are not biting on the bait... yet...

They claim its impossible to deport 11 million illegals yet they think they can scoop up 325 million firearms.


It would be impossible. I even doubt they would be stupid enough to try it. But the moonbats on the Left would certainly call for it.

Correct. If the 2nd could be repealed, it only removes any restriction on the government from violating our God given rights to self defense.

And THAT will lead to a very large and protracted period of bloodshed in which law enforcement officers of all stripes will die in huge numbers. They don't have the numbers to win that kind of conflict.

I really don't think liberals have any idea what kind of deadly havoc would ensue if SCOTUS was to repeal the 2nd Amendment

Nothing would happen. The people in the government now are so powerful, so criminal, so determined to crush any opposition, they would do it with weapons that no ordinary person in this country could ever hope to own.

It is functionally a tyrannocracy far more powerful then even the Communist slave states and brooks no opposition. Seen anyone thrown out of the government lately for going after Tea Party activists, or elected Representatives?

The bureaucracy now plans to wipe out any possibility of armed resistance which was considered a Right by the Revolutionaries. The Judges are bureaucrats: once appointed, they never go away - and anyone who tries to make them go away because of their acts will immediately find themselves up against a wall of grim, armed men.

The government has expanded and ossified into an organized gang that regards the citizenry as their plantation workers, good only insofar as they can produce wealth to be confiscated. This is simply Feudalism of a form and supremacy unseen in human history.

The Second Amendment was written to prevent exactly that. It is all but extinct. The next step by the Bureaucracy will be to permanently extinguish even that small glimmer of hope, and it will be done with the threat of force so horrific that no man with a peashooter would consider opposing.

Constitutionally and historically you are correct, however:

0bama, by himself, cannot independently change laws, but he has.
