Mark Levin's Tortured Defense of Cruz Eligibility

Mark Levin has spent years defending the Constitution, his radio show bumpers refer to him as "Mr. Constitution". In his view, the constitutional debates and the views of the founding fathers should determine its meaning.

Levin has abandoned this standard in his defense of Ted Cruz's eligibility to run for President. This is evident in at least two ways - ignoring the founders' intentions and arguments, and suggesting that there are only two types of citizenship: naturalized and natural born. Levin revisits this issue with exasperation every day, knocking Mr. Trump and others for discussing it. Last week he referred to the issue as a 'turd in the swimming pool'. Let's examine it.

Canada is a possession of the English Crown. The analog in the founders time was England itself. Levin is suggesting that a person born after the founding, in England, with English citizenship, to parents of mixed allegiance, would have passed the founders' scrutiny. That idea should seem absurd on its face.

The above is linked to a pro Trump blog. I posted it to the Bloggers forum for that purpose. To eliminate the food fights that emanate here daily between Trump and Cruz partisans, the disclaimer upfront is that the excerpt is from a pro-Trump site. That said, it is a fairly good analysis of some of the twisting that Levin is doing in his defense of Cruz.

In his emails to the Guardian, Tribe discussed Cruz’s own approach to constitutional issues, noting that under “the kind of judge Cruz says he admires and would appoint to the supreme court - an ‘originalist’ who claims to be bound by the historical meaning of the constitution’s terms at the time of their adoption - Cruz wouldn’t be eligible because the legal principles that prevailed in the 1780s and 90s required that someone be born on US soil to be a “natural born citizen.”

“On the other hand, to the kind of judge that I admire and Cruz abhors - a ‘living constitutionalist’ who believes that the constitution’s meaning evolves with the needs of the time - Cruz would ironically be eligible because it no longer makes sense to be bound by so narrow and strict a definition.”

Tribe said: “There is no single, settled answer. And our supreme court has never addressed the issue.”

Trump didn’t say the issue was absolute.

Trump said it was a legitimate issue the Dems would raise later if Cruz doesn’t settle it now.

Levin has gone full Beck. Will not listen to him until post election.

Interesting another Conservative under the bus by the Cruz Cult. I find it interesting you all loved him a bit ago but now that Cruz is being faced as a fraud, you all are taking it out on a good conservative. You guys are nuts.

I’ll say this to Levin, whom I respect very much.

Nothing you have said is enough to convince me that there is no possibility at all that he won’t be disqualified down the road.

I think Cruz is an NBC personally. But there will always be the chance that some judge and in some court will yank him at the worst possible time, and I ask myself is it worth risking my vote on when I can vote for someone who does not have this potential problem?

I don’t want to risk my vote. It’s important to me. The opinions of people who are not judges aren’t enough to convince me. This is a real problem, and I don’t care if you think that I’m kooky for being concerned about it.

When it comes to legal matters, I guess we should trust the reality star who checked with his lawyers, he hires the best lawyers you know, and declared that everything was A OK with Cruz running, but then had a change of heart when Cruz became a threat to his campaign. I’ll trust Mark Levin and his law experience, Ted Cruz who won arguments in front of the Supreme Court and the other numerous legal scholars both left and right that have cleared him to run. If Donnie is so concerned about this, six months later because he’s just trying to help Cruz you know, he should sue and get this cleared up once and for all.

Trump is making himself look like a fool more and more each day. How much has he donated to far-left democrats? How many times has he switched parties? How many issues has he switched sides? When it donates like a lib, and talks like a lib, and attacks conservatives like a lib, there’s a good chance it’s a lib.

Laurence Tribe
Tribe remembers Obama as one of his best students in his 40 years of teaching constitutional law at Harvard. Tribe has argued three dozen cases before the Supreme Court, and he literally wrote the textbook on constitutional law used across the country. He argued Vice President Gore’s side in Bush v. Gore, the Florida vote-counting case, before the Supreme Court in 2000, so it’s no wonder that he is part of the team that Obama has assembled to respond to any voting irregularities or other legal issues that arise in the campaign.

A leading liberal scholar, Tribe, 66, is also an active member of an ad hoc group of policy experts who advise Obama on habeas corpus and other constitutional concerns, as well as on increasing Americans’ access to the justice system. Tribe told National Journal that he and other legal affairs advisers worked on a set of policy proposals — but that Obama’s own ideas were better. “He’s very interested always in finding common ground,” Tribe said. “It’s not so much finding the midpoint on a line where people are arranged from left to right, but finding a way to get an angle that’s perpendicular — or comes at the line from a different angle.”

The most telling aspect is Cruz, if he truly is a brilliant Constitutional law scholar as he claims, should have known NBC issue was open to interpretation.

If Cruz was trult brilliant, he would have gotten a legal, Declarative Judgement to eliminate any question re: his candidancy.

Cruz chose NOT to get a legal ruling - perhaps knowing the result would not be to his liking.

There is a reason Cruz chose to NOT pursue this solution.
