U.S. Army Maj. Stefan Frederick Cook filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector with the intent to stall and eventually prevent an upcoming deployment to Afghanistan.
In the 20-page document — filed July 8 with the United States District Court, Middle District of Georgia — Cook’s California-based attorney, Orly Taitz, asks the court to consider granting his client’s request based upon Cook’s belief that President Barrack Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of U.S Armed Forces.
Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command, and that Plaintiff would thus be simultaneously unable to perform his duties in good Rule 65(b) Application for Temporary Restraining Order 22 conscience and yet be simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”
Cook received the orders mobilizing him to active duty on June 9, 2009. According to this document, which accompanies Cook’s July 8 application for a temporary restraining order, he has been ordered to report to MacDill Air Force Base in Tampa, Fla. on July 15. From there, the Florida resident will to go to Fort Benning, Ga. before deploying overseas.
A hearing to discuss Cook’s request for an injunction or temporary restraining order will take place in federal court Thursday at 9:30 a.m.

He’s correct in that he’s seeking clarification of the legality of a questionable order. A big stumbling block he will face is that his efforts to do so will raise the question as to why other officers senior to him have not questioned the same order.
He will lose because his status as a conscientious objector has everything to do with his moral, ethical, or religious objection to war, if any, and nothing to do with who the commander in chief is.
Obama stifles cases against Black Panthers, but can’t wait to play the race card- as you suggest, just like the news libs.

He may or may not be correct, but the United States is bigger than one person, one president, or one party. He made the commitment to serve, he should serve.

As a 24 veteran, with much of that time spent as a Navy JAG, I concur. This is a foolish avenue to explore, and I don't believe any lawyer with even a working knowledge of the UCMJ would pursue such an action. I don't know who this Orly person is, but his legal advice is suspect, at best. At worst, I see some malpractice issues.
On Sept. 20th in the South Lawn of the WH, 0 will raise the Chinese Flag. Wonder what our soldiers will think when this happens? What will every day americans think?

You can’t change the rules after game starts. Remember, it was a close election!
Suppose celebrity Republicans Governor Arnold Schwarzenegger, who was born in Austria and singer Gloria Estefan, who was born in Cuba, chose to run for President.
They would be prevented from doing so since per Article 2, Section 1 of the U.S. Constitution, one must be a natural born citizen of the United States to hold office as President. Their births in Austria and Cuba would not be considered natural born citizenship.
A case might be made that Barack Obama knew that he was not eligibile to serve as President since he’s probably not a natural born citizen. Consequently, he forged a “Certification of Live Birth” (COLB) and advertised it to the American people as authentic.
Dr. Ron Polarik analyzed Obama’s COLB and determined it to be a forgery. I firmly agree with him. The enclosed link provides Polarik’s article and displays the alleged forged document while pointing out altered numbers and discrepancies, etc.:

It is a felony to forge a government document and there could be a multitude of felony counts contained here against Obama.

We the American people have the right to know if our President is eligible to hold office. For many, Obama has not proven this requirement.
Obama, I ask, WHERE were you born in Hawaii? Prove it! Where is your original birth certificate? Where?
The authorities MUST enforce the Constitution and require Obama to prove that he is a natural born American citizen. Action on this case is past due! If the Constitution were not going to be enforced, Schwarzenegger or Estefan could have been on the Republican ticket in 2008. What law permits the Democrats special privileges?
In closing, our past Presidents have Birthplace Museums. Just to name a few, Ronald Reagan has a Birthplace Museum in Tampico, Illinois and Bill Clinton has a Birthplace Museum in Hope, Arkansas where they were born. Where will Barack Obama’s Birthplace Museum be located at? At the Coast Provincial General Hospital in Mombasa, Kenya?

To serve the President of the United States, at his pleasure. At least that's what his commissioning warrant states. Subordinate officer (and enlisted) don't get to question the authority of command. Although a subordinate can challenge the legality of an order, they can't challenge the authority of a superior to issue that order (except in extremely limited circumstances), so long as that superior officer is in the appropriate chain of command. It's a subtle difference, but not at all an insignificant one.
This isn't even a close call. Barack Obama is the President. Military officers don't get to question if his election was valid or if he's fit for command. This Army officer will lose and his attorney has exposed him to prosecution under several Articles of the UCMJ.
This one isn’t going to fly. He is already in the military. Now it would be interesting if there were a draft and the refusal for avoiding the draft were that he doesn’t recongize the President as legitimate.
