** VOTER GUIDE ** NOV. 2nd 2004 * BY: David C. Osborne (Leon County, Tallahassee, Florida)

PROPOSED CONSTITUTIONAL AMENDMENTS

Amendment #1 - YES - Parental Notice for child obtaining an ABORTION

Amendment #2 - NO - Requires Supreme court to rule on "validity" of PROPOSED constiutional amendments - I don't think so... the purpose of a proposed constitutional ammendment is for the PEOPLE to tell the supreme court what is "valid" not the other way around...

Amendment #3 - YES - Medical Liability - Requires claimant/victim (not lawyer) to get 70% of the first $250,000 and 90% in excess of $250,000 (excluding reasonable costs)

Amendment #4 - YES - Allows slot machines in Miami-Dade and Broward County at parimutuel Facilities - only allows slot machines at locations where other gambling is taking place... is not an authorization to put them in every gas station etc.

Amendment #5 - YES - CREATES a Florida Minimum Wage $6.15/hr - indexed to inflation - I believe the min. wage should vary state to state and this is a step in the right direction for FLORIDA...

Amendment #6 - YES - REPEAL HIGH SPEED RAIL - and its $25 BILLION price tag

Amendment #7 - YES - Paitents right to know about Adverse Medical Incidents - WE ARE THE "SUNSHINE LAW" STATE ! - and this is in keeping with that principle

Amendment #8 - YES - Public Protection from REPEATED Medical Malpractice - Oddly enough under current law a doctor who has been FOUND to have committed 3 or more incidents of medical malpractice can still get a license - VOTE YES to fix this

-----------------------

PRESIDENT and Vice PRESIDENT - George W. BUSH and Dick CHENEY

-----------------------

UNITED STATES SENATOR - Mel MARTINEZ * Although my first choice was Bill McCollum

-----------------------

UNITED STATES REPRESENTATIVE - 2nd District - Bev Kilmer * personal note * I consider this to be vote AGAINST Allen Boyd and not a vote FOR Kilmer - I think we can do better in 2 years -

-----------------------

STATE ATTORNEY (2nd Judicial Circuit) - William N. "Willie" Meggs - The ONLY DEMOCRAT on my ballot I will be voting for..

-----------------------

STATE REPRESENTATIVE (8th District) - Write in the name of anyone you want - the Only candidate in this race is a liberal Democrat -

-----------------------

LEON COUNTY TAX COLLECTOR - Don PUMPHREY ** here again, this is a vote AGAINST Doris Maloy and not FOR Mr. Pumphrey

-----------------------

LEON COUNTY SUPERINTENDENT OF SCHOOLS - Patricia A. SUNDAY

-----------------------

JUDICIAL RETENTIONS (Vote to Retain yes or no)

Supreme Court Justice Kenneth B BELL - YES

Supreme Court Justice Raoul G. CANTERO - YES

1st District Appeals Court Justice Michael E. ALLEN - YES

1st District Appeals Court Justice Edward T BARFIELD -YES

1st District Appeals Court Justice Paul HAWKES - YES

1st District Appeals Court Justice Charles J. KAHN, Jr. YES

1st District Appeals Court Justice Phil PADOVANO - NO (liberal Activist Judge)

1st District Appeals Court Justice James R. WOLF - NO (liberal Activist Judge)

I ain't in FLA but "Whhhaaaaat?" Minimum Wage is bad and contra-capitlaism. It hurts those it should help.

I think a min wage on the STATE level is good... I am opposed to a FEDERAL min wage however...

No difference as far as the economics goes. It is inherently anti-capitalism. Do you understand the reverberations of a minimum wage irrespective of who imposes it?

I'm waiting for my voter guide her in Citrus Co. We should be getting it in a week or two. I always go thru it & cross out all the liberals & even some of the so called Republicans. We have loads of problems with the judges down here & need to make sure we vote them out.

I don't know if I would vote to retain any of the Florida Supreme Court Justices who were on the court during the last Presidential election. I felt that they were practicing liberal activism by ignoring the state election laws.

As far as I've been able to find out, both Bell and Cantero were appointed by Jeb after 2000.

I wish the Republican Party of Florida would endorse the amendments they want through. It would help.

I found your endorsement of the judges useful. There is positively no way to learn about the judges we must vote on.

And, Republican headquarters in the counties are not allowed to make recommendations or endorsements of any of the justices, as you probably know.

Justice Hawkes was also appointed by Jeb.

You can read their resumes at www.flcourts.org

Both Supreme Court justices on the current Supreme Court who are up for retention votes were not on the Court in 2000.

Both Justices Bell and Cantero were appointed by Jeb Bush in 2003, I believe.

You may check this out for yourself at www.flcourts.org

Obviously David Osborne who posted his recommendations is in favor.

I will vote not on this. I believe it will put an additional burden on Florida. Florida is already reeling from four hurricanes.

For the 2nd District Court of Appeals, the following were appointed by JEB (and after 2000): Canady, Kelly, Villanti, and Wallace. Steven T. Northcutt was appointed by Lawton Chiles in 1997.
