Virginia argues that they don't need to send out military absentee ballots in time to vote

The State of Virginia has argued in a federal court filing that they can legally send out absentee ballots to active duty soldiers the day before an election. Restated again, the Democratic Chairwoman of the Virginia State Board of Election (appointed by the Democratic National Committee Chair Tim Kaine, in his capacity as Virginia Governor) Jean Cunningham just claimed a legal basis for massively raising the barrier to voting for soldiers at war.

This is remarkable, and the implications of this should be understood. First of all, some counties in both Virginia and New Jersey haven't sent out absentee ballots yet in violation of their own laws. Whether due to maliciousness or simply being overburdened and understaffed is always up for debate. If Virginia prevails, there would be a legal argument for putting the ballots of active duty military at the back of the bus, as it were.

Second, this whole debate concerns only federal elections. States have to pass laws that allow for military voting in non-federal elections. I do not believe that either state has done that. Virginia's filing notes that many of these questions are irrelevant in many ways because of the Federal Write-in Absentee Ballot, but their flier on military voting notes "Virginia allows you use the FWAB as an absentee ballot for Federal Offices only". In other words, not state and local elections. In fact, state laws have to do more to let active duty military vote in state elections.

Third, if ballots were even to be sent out in a reasonable time, a question is them getting back in time. Rep. Kevin McCarthy, Rep. Dan Boren, Sen. John Cornyn, and Sen. Mark Begich have a proposal to have DoD pay for ballots to be returned by express mail, but Steny Hoyer and Nancy Pelosi are blocking consideration in the House, even though it passed the Senate last year.

This is absolutely reprehensible since we know their goal is to effectively deny the soldiers’ the opportunity to vote.

When Obama succeeds in packing the Supreme Court and the lower courts, the takeover by the statists will be complete and free and open elections will be a thing of the past. It won’t matter if Republicans do or don’t get their ballots since the Courts will simply say that it is up to the States to run their elections.

Can the military as individuals have other people in Virginia file for the absentee ballots and get them mailed to them in time? Many of them have to have wives,Moms and Dads in VA?

So how is there any meaningful redress in this situation?

After the election is over, What exactly can be done to remedy the Harm done in denying a whole class of citizens their right to vote?

As an active duty person currently stationed in Virginia let me say this...at least 1/3 of the military stationed here, and in most areas, are not residents of the state we’re stationed in. My permanent residence is still OH, and will stay that way until I retire next year. This is for tax purposes more than anything else. OH did get me my ballot, but would not send it to Iraq where I was stationed during the Presidential election. My wife got it, at home, and had to forward it to me. As such, it was late in getting back to OH and I’m, along with several thousand others, was not counted. Any reason some computer savy folks can’t make an electronic election we could do online? We do it with military stuff all the time. Just a thought..

This situation calls for a little jiu-jitsu - if the Virginia GOP had any imagination, they could throw this in the Democrats face with a PR barrage that would make them look like the slime they are.

I’ll bet Breitbart could point them to some producer who could put together a killer commercial that would embarass those pr*cks so much that they’d be afraid to show their face in public.

Remember, this is the party that p*ssed and moaned in Florida 2000 about making sure everybody’s vote counted - apparently everybody who’s not in uniform, that is.
