An Army doctor charged with disobeying a deployment order because he doubts President Barack Obama's credentials as commander in chief is asking a military judge for access to the president's school and college records. Lt. Col. Terrence Lakin also is requesting during a hearing Thursday at Fort Meade a subpoena to depose the custodian of Obama's birth records with the state of Hawaii.

Not really. The orders were issued as part of an overall directive from the White House. Lakin's superiors weren't arbitrarily issuing these orders independent of the CinC's strategy on Afghanistan. The affadavit from Gen. McInerny suggests the foundation of all orders is impacted directly by Obama's lack of eligibility.
If past history is any judge Lakin's motivation won't be seen as relevant. The court will be concerned with if he refused to obey the orders of his three superior offices, not why he did it. Officers like Yolanda Huet-Vaughn and Ehren Watada, and enlisted men like Michael New all tried to make their reasons for refusing to obey orders part of their trial and they failed in every case. And the investigating officer for his Article 32 hearing said as much in his report when he denied defense requests for any documentation concerning Obama. Lakin will be tried and convicted without Obama being brought into it. And I suspect the Army will throw the book at him as an example to discourage anyone else who might choose to follow his lead. He could well wind up in Leavenworth.
Two of the counts charge that Lakin refused to obey the orders of his superior officer to report to the office of his brigade commander. A third count was refusing to obey the order of a superior officer to report for temporary duty with the 101st. Are you saying Obama originated all those orders? Or that the brigade commander cannot order one of his own officers to report to his office? You, and Lakin, will have a difficult if not impossible time proving that at his court martial.
Lakin refused his orders because they weren’t based on a lawful foundation. If he’s not allowed to make that case, then he’s being denied due process. It’s one thing if the court disagrees with the conclusion of unlwafulness, but it’s a different thing to deny someone a fair trial.
I’ve explained pretty clearly that these orders were issued in support of Obama’s Afghanistan campaign. The temporary duty assignments weren’t for routine, day-to-day operations.
Lakin will get every chance to try and show in court why the orders of Colonel Roberts and Lieutenant Colonel Judd for Lakin to report to his brigade commanader's oficer were unlawful, as well as why the order of Lieutenant Colonel McHugh to report for duty with the 101st was unlawful as well. He doesn't need any documentation on Obama to for that.
Order to report to his brigade commander were in support of Obama's Afghanistan campaign? You will have a very hard time making that case in court.

Any of you happen to know what happened in court today, and if there is any truth to reports that Lakin has been confined to a locked psych ward????

On November 9, Brooke Army Medical Center spokesman Dewey Mitchell announced that Hasan had regained consciousness, and been able to talk since he was taken off a ventilator on November 7. On November 13, Hasan’s attorney John Galligan announced that Hasan was paralyzed from the waist down, and will likely not walk again. In mid-December, Galligan indicated that Hasan was moved from intensive care to a private hospital room, yet still remained under guard while recovering. Galligan further stated that doctors said Hasan would need at least two months in the hospital to learn “to care for himself.”

Where did you hear that about Dr. Kate stating that Lakin has been locked up & away in a psychiatric ward?
Is it a MILITARY psych ward? Or is it civilian? WHERE is the psych ward, what hospitial, which city/state??
I am very curious if maybe the MILITARY has temporarily “stashed” Lakin somewhere where they believe that no one can assassinate him.

The military wants this to be about their orders only -- but their orders are meaningless outside of the chain of command which requires a legal CiC.
