Arguments in a lawsuit that has been percolating through the federal court system in California since Barack Obama's election on his eligibility to occupy the Oval Office is going to be heard at the appellate level in just a few weeks.

Officials with the 9th U.S. Circuit Court of Appeals today notified attorneys representing several dozen individuals – members of the military, members of state government and even a candidate for president – that oral arguments will be held on May 2.

"I can't believe it, but after two years of Obama litigation, for the first time the court of appeals scheduled oral argument in [the] Obama case," wrote Orly Taitz, a prominent California attorney who has litigated a number of challenges to Obama.

"This is [the] Judge Carter case, where I represent Ambassador Alan Keyes, 10 state representatives and 30 members of [the] U.S. military," she wrote in her blog confirmation of the plans.

That's just another one of the many made up urban legends on this subject. Like Pakistan not allowing people with US passports to travel there in the 80s. It also has the benefit of being one of the “vast conspiracy” variants, making it immune to rational analysis because there's always someone who could have succumbed to mysterious, unprovable pressure to falsify records.

I will repeat, the idea that the information on the COLB is wrong works only if the entire State government of Hawaii is implicated in the cover up. You can believe that if you want, but don't expect to be taken seriously by rational people.

Definitely. They will simply codify that one does not have to, if one is a lefty anyway, prove eligibility at all. Because proving eligibility to BE president would just disenfranchise or suppress the vote or something. You know the same way proving eligibility to vote does in leftyland.

The POTUSA pot is legally open to anyone who qualifies as a natural born citizen. No competent legal authority has disputed that Obama does.

There's no requirement for a Presidential candidate to present his birth certificate to you or me. The Obama campaign is the only one in my memory that did.

Several candidates, including Eisenhower and McCain have been asked to prove their eligibility. They simply did so. Soetoro didn't present a birth certificate to "you and me" because a photoshop image on Soetoros website is not a birth certificate.

What he posted on the Internet as an informational courtesy only. It conforms with his biography...

... and the type of documentation the state of Hawaii issues. If it didn't comport with the state of Hawaii's records, the state had every right to say so.

There is no legal privacy protection for fraudulently prof erred state documents. Yet not only has the state of Hawaii not disputed Obama’s COLB, but the Republican Governor said they checked and its information conforms with the information they have.

Those statements are not as straight forward as you imply. Your assertion also ignores that the law requires they produce documents they rely upon for official statements and they have refused to do so.

The state of Hawaii has never verified that the COLB claimed to be Obama’s is authentic at all. They have parsed words in legal fashion to let the left-wing spin it that way. It is you who are presenting an urban myth.

And yet Hawaii has never once implied there's any problem with the document the Obama campaign posted as a simple courtesy to the curious. They've actually said its information conforms with the records they have on file.

Okubo Refuses To Authenticate COLB

PolitiFact.com actually has Okubo on the record denying that the electronic COLB image provided by the Obama campaign can be authenticated by her or by anyone at DHOH!  But that was only in a follow-up to their initial story where Okubo said the COLB was a valid Hawaiian birth certificate.

 

PolitiFact.com describes the controversy that erupted from their initial story:

      

"When the birth certificate arrived from the Obama campaign it confirmed his name as the other documents already showed it.  Still, we took an extra step: We e-mailed it to the Hawaii Department of Health, which maintains such records, to ask if it was real."

      

"It's a valid Hawaii state birth certificate," spokesman Janice Okubo told us.

    

"Then the firestorm started."

       

After the "firestorm," Politifact apparently conducted a follow-up interview with Okubo which shows that what Okubo meant was that the Obama COLB only appeared to be be a valid Hawaiian BC, but she could not and did not "verify" that it was a valid Hawaiian COLB BC.

       

Politifact: "Okubo says she got a copy of her own birth certificate last year and it is identical to the Obama one we received.

 

"And about the copy we e-mailed her for verification?  'When we looked at that image you guys sent us, our registrar, he thought he could see pieces of the embossed image through it.'"

 

"Still, she acknowledges: 'I don't know that it's possible for us to even say beyond a doubt what the image on the site represents.'"

 

Okubo had to back off her original claim.  And a good thing ... she originally said Obama’s alleged COLB was real because it looked like her own.  In other words, she used no formal technique to verify its accuracy.  She relied on no official record to verify its accuracy.  She just thought it looked like hers.  At best, she follows up with a second-hand anecdote, "... our registrar ... thought he could see pieces of the embossed image ..."

He did show valid birth documentation. What he put on the Internet looks exactly like the most recent one I got from my state, save for the color. It’s more than any other Presidential candidate before him did. And what happened?

You folks proceeded to go nuts, relying on obviously unqualified frauds who have long been exposed to rant about how the COLB he wasn’t even required to show you was fraudulent.

You’ve since constructed an elaborate array of legal fantasies as to why he’s not eligible even if the COLB is valid.

And yet you think it a salient point that he refuses to further waste his time on you. Talk about self-absorbed delusion.

I hope that there is something in this lawsuit that challenges Obama as to his legal name as well.

Most evidence points to the fact that he was adopted, name legally changed, became an Indonesian citizen and that he never legally changed his name back but instead just started calling himself Barack Obama and used a phony social security number.

I also hope that motions are filed in regards to the question of why Pelosi and the DNC removed the term ‘natural born citizen’ from the form required to get on the ballot in 49 states.

Of course the idiots who defend him never address these issues.

You keep on making false statements. Obama has not produced more then anyother Presidential candidate at all. McCain produced his original long-form birth certificate to the press and to Congress and they passed a non-binding resolution in order to state his elgibility.

She simply said what any competent person would. It looks like it, but we don't make definitive determinations on Internet images. If, however Hawaii had no record of Obama's birth, or the records differed from what was shown, the state is legally free and clear to say that. You guys will simply never admit Obama is eligible for your own psychological reasons, so you set up arguments based on half truths and omissions.

How about this: “I, Dr. Chiyome Fukino, director of the Hawaii State Department of Health, have seen the original vital records maintained on file by the Hawaii State Department of Health verifying Barack Hussein Obama was born in Hawaii and is a natural-born American citizen. I have nothing further to add to this statement or my original statement issued in October 2008 over eight months ago....”

Again, I know you have a whole cottage industry spinning delusions about this, but its meaning is clear to rational people. The same as the Republican governor's statement that she had the information on record reviewed and it checked out.
