Has Ann Barnhardt been arrested by the Feds?

Ann Barnhardt declared a tax strike and had her bank account seized by the IRS in November. She has not posted on her site for nine days. Does anyone know what is going on with her?

Others have tried to do the same thing and have found themselves in prison for it. They will definitely try her for tax evasion of she does.

You can’t declare a tax strike, and have your bank account “seized” right away. The IRS doesn’t work that quickly. So, did she refuse to file for 2011? If the Tax Court heard her case that quickly (doubtful), where’s the record of the judgment?

You do understand that the MF Global decision exonerating Jon Corzine of any consequences for stealing $1.6 billion of customer-segregated funds means that no account you have is safe from government theft, right?

Right. Crazy enough in her commodities business to see what MF Global and the criminal Corzine were doing with her client’s money. AND, got them all out of the market so doing, saving their principal money in her managed accounts. She is a heroine.

Corzine is a criminal, a major one- who stole personal money from the very AMERICAN producers of our FOOD, so he could cover a too clever money play on the Greek drachma- a thief of legendary status (more than Madoff). And obama bundler. THIS is what gets Barnhardt a federal clampdown— directed by the gestapo in obamao land of the “new world” federal enforcers.

She is mistaken in taking the tax protest stance— there are many tax attorneys and foundations that would/will represent her. And, if she has had bad accounting then this would come out.

There is a lawsuit, one of many, brought by Montana ranchers against Corzine:

Now, you may not LIKE her religious bent (which is Catholic btw) or “end of the world” belief— but you cannot fault the biblical basis of her code of ethics. Her stance is a brave, and emotional one-not unlike the emotionality of the founding of this Republic.
Where does this monstrosity of a federal totalitarianism end? Where WE the people stop it, that’s where.

As a lawyer, I litigate against the IRS fairly often. There is no legal way the IRS can levy your property without at least giving you the opportunity to challenge it in court first.

First, they cannot collect taxes without an assessment. An assessment of income taxes can ordinarily come about only in three ways: (1) you file a tax return, show a tax due, but don't pay it; or (2) the IRS sends you a notice alleging that you underpaid your taxes, and you don't file in Tax Court within 90 days; or (3) you file in Tax Court and lose.

Even after an assessment, the IRS cannot file a lien or levy without telling you they are going to, and giving you the opportunity to request a Collection Due Process Hearing; if you request a CDPH and lose, you can challenge that in Tax Court as well.

So no one has a lien against them unless they either went to court and lost (twice), or ignored a whole batch of IRS notices.

Ann previously shut down her grain brokerage and other businesses. I believe (believe) she said she was not going to pay any taxes on them on Constitutional grounds.

On October 27, 2012 (Ann's 36th birthday), Ann posted:

I’m not saying the IRS can’t levy your bank account, I’m just saying they give you the opportunity to go to court first. If she throws away IRS notices unread, she probably lost her chances to go to court.

THe nice thing about a thread like this is how the goal posts can move so often.

We went from wondering if the IRS might have struck a retaliatory strike against her for saying bad things about them, to a post showing how she has ignored all legal remedies for them collecting what they say is due.

Hard to tell from what I’m reading whether she really should have owed money, but she doesn’t appear to have done anything to defend her position.

At one point in my life, I went 4 years without filing my taxes, mostly because I was having trouble coping with some large stock losses and the doing the tax forms would make it “real”. Eventually, the IRS sent me a bill for $72,000, since they based the amount on my total stock sales, ignoring the churn and how much I had lost.

If I had done nothing, I guess they would have collected that money. Of course, not being an idiot, I bought a tax program and did my taxes, and got a huge refund (I had been withholding all those years) complete with interest.

How smart is it, if you think the government is evil, to go out of your way to give them your money, as she seems to have done?

As a Lawyer, you'll appreciate the stupidity or "boldness" of this move.

Here is what Ann says she was going to do:

I'll just give you an example so you know what I mean. I found out that when you don't file with the IRS, what they do is "subpoena" your bank statements from your bank, and then they simply go in and add up all of the credits in your bank account and IGNORE ALL OF THE DEBITS. No expenses are recognized whatsoever. Every dollar "in" is considered to be pure, fully-taxable income.

Sounds horrible, right? Especially if you are a business owner like me, right?

So, how do I make this work for me? Simple. I'm going to get some cash deposited into the bank in a quantity that I am prepared to lose, and then I am going to login to my online banking interface and sit here all blessed day and transfer that quantity of money between my bank accounts. I'm hoping to "generate" "income" in the form of credit entries on my bank statements into the eight figures.

She is absolutely right -- if you don't file an income tax form, they presume that all your deposits are income, all your stock sales are zero-cost basis, etc.

How this "works" for her is beyond me. It just seems she has come up with a scheme whereby she can give the IRS legal justification to seize everything she has.

This is like "getting" the man by confessing to crimes you didn't commit. Sure, I guess they look stupid because they convict an innocent man. On the other hand, you confessed and now are in prison.

I actually enjoy reading some of what she writes, and I think she actually knows what she is talking about from time to time.

Unfortunately, the wise counsel is interspersed with lunacy.

That's been tried over, and over and over.......ad nauseum and the ultimate result is you pay your taxes or go to jail......
