Judge Napolitano: Hillary Will Be Indicted if AG Loretta Lynch Convenes a Grand Jury

Attorney General Loretta Lynch confirmed to Congress last week that career Justice Department attorneys are working with FBI agents on the ongoing criminal investigation of Hillary Clinton’s email practices and possible public corruption at the Clinton Foundation. According to legal experts, this gives agents "access to the U.S. government’s full investigative tool box, including subpoena power for individuals, business or phone records, as well as witnesses." Fox News legal analyst Judge Andrew Napolitano says that if Lynch presents their evidence to a grand jury, "Mrs. Clinton will be indicted."

Judge Napoitano reported on Fox News this morning that the final batch of Hillary Clinton’s emails set to be released Monday include information on drone strikes "which are in the highest category of top secret." He argued that Clinton, as secretary, was obligated to know "a national security state secret" when she saw one.

"'Classified' is Hollywood term, not a legal term. The legal term is confidential, secret or top-secret. So when she says, 'I didn't send or receive anything marked classified,' it is technically true. The answer is nothing is marked classified," he said.

The judge noted that former CIA Director Gen. Michael Hayden recently called it "certain" that the Russians hacked into Clinton's unsecured server.

Loretta Lynch has no intention of pressing any charges against Hillary Clinton. The most that would come of this would be one of her former underlings laying him or herself down as a sacrificial lamb for a misdemeanor charge.

Hillary has nothing to fear.

Hillary will be indicted by the Obama “Justice” Department when monkeys fly out of Obama’s butt.

The best that we can hope for is that career FBI agents will leak the details of their investigation after Lynch refuses the FBI’s recommendation to pursue an indictment.

You are probably right about Loretta Lynch, but HRC shouldn't relax. If the FBI investigation concludes with a recommendation that HRC be indicted for a felony, and Lynch declines to indict, the FBI will leak the contents of the investigation. If the leaks happen before HRC is elected, Trump will hammer away about the private server and the Clinton Foundation; if the leaks happen after HRC is elected, the media, despite being in-the-tank for HRC, will not be able to resist Watergate II.

It’s a good sign. The FBI has been working on the investigation far longer than most know. Possibly starting not long after Jan. 2014. That’s when the hacker was arrested that made them aware that Hillary had a private server.

That explains why the FBI has so many agents assigned to the investigation. There are that many criminal acts to document both as far as classified information and the other aspect involving misuse of a public office.

What we’ve heard out of Lynch recently may indicate that Hillary runs a very real chance of indictment simply because of the multitude of counts. My guess is based on the number and severity of violations she could potentially face upwards of a thousand years in prison if the sentences run consecutively.

Will that happen? I’d be surprised if it goes that far. Possibly due to national security issues she can never be brought to trial. That doesn’t mean she won’t suffer consequences. Like Petraeus she’ll be penalized. I don’t see her getting off with a misdemeanor. More than likely health issues will intervene and she’ll be out of the running for the presidency and any further public capacity.

We’re seeing history in the making. Hillary is about to become a huge liability for the Democrat party.

If the FBI has been investigating this for 2 years, then they may be ready to recommend an indictment before the end of Hillary’s second term.

We’ll know the investigation is wrapping up when Hillary’s aides are subpoenaed. A judge recently said Judicial Watch could subpoena Hillary and her aides after they settled on procedure in April. I doubt the FBI will go second. If so, that means subpoenas this month or next.

Since Judicial Watch is only focused on the mishandling of classified information they are not going after the bribery that is the other part of the FBI investigation.

I’ve heard this bandied about.

Some people are making the claim that the sensitive nature of the documents will make it impossible for a GJ or a criminal jury to be seated, as even members of Congress on the Intelligence committees are not cleared to see so much as the redacted portions of some of the emails.

Hope someone here can put my mind to rest on that one.

Then the next President, Trump or Cruz, tells his new AG to convene a grand jury to indict both Hillary for her numerous felonies and ex-AG Lynch for the crimes she did in office.

If FYI Director Comey has any integrity he will ask that Loretta Lynch recuse herself when he makes the recommendation to pursue charges. If Lynch is actually stressing over this falling in her lap, she might actually recuse herself. We’ll never know if the request isn’t made.

My understanding is that Loretta Lynch is no Eric Holder.

Eric Holder was a radical first, who took part in the violent occupation of buildings while a student in Columbia University.

Lynch is less ideological, more of an ambitious climber, who leverages her Democrat Party connections to advance. She spent a lot of time as a prosecutor. Although the Party could call on her to handle cases they wanted prosecuted, she was relatively professional in handling other cases. She had a pretty positive reputation among FBI Agents who had worked in her district, when she went to her confirmation hearings.

She is much less likely to stick her neck out with a brazen abuse of office than Holder would be.
