Constitutional Crisis: Activist Federal Judge Orders DHS Complete restart of 'Dreamers' Program

Trump’s administration received a serious setback on Wednesday, following an activist Federal Judge’s decision, which forces the Department of Homeland Security to resume the Dreamers Program, an Obama-era (illegal/unconstitutional) executive order that protects hundreds of thousands of illegal immigrants from deportation. More precisely, U.S. District Judge John D. Bates for the District of Columbia said on Wednesday that the White House was “arbitrary and capricious” with regard to trying to end Barack Obama’s Deferred Action for Childhood Arrivals program, and basically forced the DHS to resume it, while claiming the Department of Homeland Security had failed to explain him (the judge that is) why DACA is unlawful. Therefore, since Judge John D. Bates seems to believe that DACA is completely “kosher”, the Trump administration’s efforts to end DACA must be set aside/stopped, and DHS has 90 days to, let me quote, “better explain its view” on why DACA is illegal/unconstitutional.

Will be struck down by SCOTUS, assuming they take up any case filed by the executive branch. The problem is, how to stop these district court a$$wipes from issuing decisions that go against black-letter law.

It already went to SCOTUS on an emergency basis a few months back. They said it had to go through the lower courts first.

The judge, John Bates, was appointed to the Federal District Court by George W. Bush. Prior to being a judge, Bates worked for Ken Starr’s Office of Independent Counsel on the investigation into the death of Deputy White House Counsel Vincent Foster. Patrick Knowlton, who was in Fort Marcy Park the day of Foster’s death, and who was a Grand Jury witness regarding the case, makes serious accusations against Bates here http://www.fbicover-up.com/miguel-rodriguez.html In February of 1997, while working for the OIC, Bates sent me a letter denying my federal Freedom of Information Act administrative appeal that immediately preceded my lawsuit. I have been reading various articles on this and thing the problem is with the DOJ sending up incompetent attorneys that likely are trying to lose the case. Read the details and the judge is trying to tell them how to argue the case, which they have not done. The problem is the attorneys, not the judge.

Obama admitted he didn’t have the right to do what he did, but did it anyway. Now a judge is demanding that President Trump break laws again.

This judge needs to be impeached.

No objective judge would dare rule in favor of one executive order over another.

It's the prerogative of the POTUS to create EOs, as well as undoing the illegal EOs of the former president.

A member of the judicial branch just ordered the executive branch to ignore laws passed by the legislative branch. At what point do these activists judges become a constitutional crisis? I mean if this isn’t the worst offense I’ve ever seen, I can’t think of what is. It’s not the most extreme case of judicial activism but it’s the most extreme and overt act of judicial supremacy that I can think of for sure.

What the judge has said is though other courts have denied one President’s Executive Order is now enforced and expanded by another President.

Talk about a Constitutional Crisis. Jackson once said:”Marshall has made his decision; now let him enforce it.”

Me Favish, thank you for all of your research into the Foster case. You are a hero in my mind. I read many of your posts here back in the day. You were one of a good number of real researchers here near the beginning of FR. Thank you, sir.

If FReepers today would read what you have linked here today, they might recognize the same pattern of behavior we are seeing in the FBI and Mueller investigations today. These liars are and seditionists have been doing the same things for many years to hide theirs evil deeds.

It is an illegal order. The judge doesn’t obey the law or the basis of the law’s foundation: the constitution. Thus, there is no reason for any other branch of government to adhere to his ruling. Trump should tell him to pound sand.

Ignore it while appealing it, if possible. I’m beginning to think that these judges are ruling as far afield as they can, hoping that congress will impeach him if he fails to obey their clearly unconstitutional rulings. Madness.
