Flynn Withdraws Plea Deal in Sydney Powell’s Scorched-Earth Motion

Sydney Powell is not messing around with these corrupt DOJ lawyers. – Former National Security Advisor Lt. General Mike Flynn filed a motion to withdraw his plea of guilty in his entrapment case on Tuesday. The move comes a week after the government lawyers had reneged on their previous sentencing agreement with Flynn, and recommended Gen. Flynn serve jail time for allegedly misleading FBI Peter Strzok and Joe Pientka in the January 2017 entrapment meeting that helped to create the pretense for the Mueller Witch Hunt.

Flynn’s attorney, Sydney Powell, filed a motion that scorches the earth on which the corrupt DOJ lawyers prosecuting this case stand. The full motion can be found at this link. Here are some key outtakes from it [Bolding added for emphasis]:

Michael T. Flynn hereby moves to withdraw his plea because of the government’s bad faith, vindictiveness and breach of the plea agreement…

Only after new counsel appeared did the government for the first time demand an admission and testimony from Mr. Flynn that he knew and intended when he signed the FARA registration form that it contained several material false statements. Not only was that demanded testimony a lie, but also, the prosecutors knew it was false…

The prosecutors concocted the alleged “false statements” by their own misrepresentations, deceit, and omissions…

Not only did Mr. Van Grack [lead government lawyer for this case] demand false testimony from Mr. Flynn about the alleged “false statements” in the FARA filing, but Mr. Van Grack also knew it was false because Mr. Flynn had explained it to him on June 25, 2018, in preparation for his testimony to the grand jury…

In pure spite, the government retaliated and sought to rescind its judicial admissions that Mr. Flynn was not a co-conspirator, obtained an ex parte emergency order from Judge Trenga, including a gag order, and moved up the date of the hearing on the issues without notice to counsel for Mr. Flynn. An agent improperly contacted Michael Flynn, Jr.…The prosecutors placed him on the witness list solely to harass him and to raise the threat and anxiety of the family at this crucial time. The prosecutors completed the trial without calling him as a witness…

Justice is not a game, and there should be no room for such gamesmanship in the Department of Justice…

The Government’s tactics in retaliation for Mr. Flynn’s refusal to “compose” for the prosecution is also a due process violation that can and should be stopped dead in its tracks by this court…

Keep praying for General Flynn. Great lawyers are invaluable, and he has a truly great one in Ms. Powell. But the government’s powers to abuse the process are enormous, and the judge in this case appears to be willing to turn a blind eye to the clearly corrupt manner in which this case has been conducted all along.

He didn’t withdraw anything he filed a motion asking the court to allow him to withdraw his guilty plea. And I’m not certain this is even the best strategy for him. We will see.

Yep. Trump now knows the degree of the conspiracy against him. How he handles this will be interesting to watch. I hope the ComDem POLs get fried in their own sliminess.

If Flynn believes he’ll get a pardon from Trump after the election - which I think is likely - then anything that delays the moment he has to go to jail is a good thing. If the judge agrees to let him withdraw the plea agreement, a trial would push back sentencing months even if he is convicted.

She says what they did can and should be stopped by the court. How is that not correct?

FWIW Larry Klayman claims that her appearances on Fox News, etc., hurt her client’s cause with the judge.

I wonder if this is Ms. Powell’s preparation for the appellate court.

By putting Judge Sullivan in the position of ignoring proprietorial malfeasance, an appellate court might reverse his ruling.

My understanding of the appeals process is that the appellate court looks only at the evidence presented at trial in the lower court and whether that evidence was properly ruled on/used, etc.

If that is correct, and it may not be, then there is the further question of how much of the information Powell has produced was properly introduced so as to be an essential part of the original trial.

There is a process that allows a new trial when a sufficient amount of new evidence is discovered, but I don’t know what that process is.

I hope a lawyer who is experienced in the appeal process would comment.

Actually my attorney is highly experienced in this area, but I am not going to pester him every time I have a brainstorm on FB.

Certainly, that is the opinion of those Democrats who are sweating bullets over their criminal liability thanks to Mr. Barr and his team. Attacking Barr is the only tactic that they have left.

Here we are three years later and Trump has still not fired all the commie assholes in DOJ,FBI,CIA,Military and State Dept’s. What could he possibly be waiting for. I think that he could arguably be allowed to dismiss all civil servants also based on their acting overwhelmingly like political appointees. Do it!!!!!! Fire them all.

Only after his praise of Wray, Epstein investigation, his silence on FISA so far, and still not person indicted or showing the slightest fear of indictment.

Your sweating bullets is not backed up by the facts. All of the people supposedly sweating bullets are still vocal critics of the President, suing the government, etc... they show no fear. Hell, Ohr not only has a job, but got a large pay raise and bonuses.

This case tells me Barr is not in control and has no plans to prosecute democrats.

He's a phony. When he huffed and puffed about Jeffrey Epstein being found dead when 10 highly unusual and unlikely things all happened at the same time but then signed off that it really was just a crazy kooky coincidence, I saw how he plays it.

Come out with loud righeous indignation, get the big headline about how DOJ is taking this very very seriously, then quietly sweep it under the rug when nobody is paying attention anymore. In Epstein case, it was done in a few days. In the whole coup invetigation it's playing out over months but I have 0% confidence that anything will happen to anyone who participated. None!

I hope that President Trump pardons Flynn the day after the House approves the EC votes from his massive upcoming victory. Flynn was lied about and to, all in an attempt to bring down Trump. He deserves NONE of what has happened to him, and he needs to have his record completely cleaned and never be subject to prosecution again by the Feds. Then we can talk about restitution of all of his legal fees, and some kind of settlement for the damage to his reputation.

The criminal leftists call him that because he’s effective and he’s investigating things they want shut down. Their best way of defending themselves is to harass and harangue and then after months of denigration, then claim it’s old news and not worth talking about even when it’s literally breaking new stuff.

The conservative side of people who are calling him that is simply the missing pieces he’s not taking care of, praise for the Über-corrupt Wray and the pace that makes a slow snail look like Ussain Bolt.

Mr. Barr is a very effective Attorney General. Fighting the Deep State will take a generation. Small minded people who think that rooting out the embedded corruption can be turned around within a news cycle are simply not capable of understanding what is going on.

A perfect example is action of the new FISA Court lead judge who appoints a partisan deep stater to oversee the reforms of the FBI FISA processes. This could be either total naivete or a diabolic scheme. Who knows? Moreover, it doesn’t matter because the effect on honest government is the same. I know many people who live and breed in this swamp and I am frequently surprised when I find out how they are so ignorant about what is going on within their little world. When challenged, they usually say, “but, he is an Ivy Leaguer, he has a PhD, and he worked for Senator Foghorn, how could he do something wrong?”
