Mother Caught Handcuffing Daughter

An Evansville mother is behind bars for putting her teenager in handcuffs to "teach her a lesson". Dawn Wininger is facing neglect charges. Police say officers were sent to east Missouri Street and found Winingers' 13 year old daughter in handcuffs. She told police her mom had handcuffed her four or five hours ago. Wininger says she put the handcuffs on her daughter but had intended to take them off after a only few minutes, but fell asleep. Child Protective Services took custody of the girl and a 5 year old child, who was also in the house at the time.

So now being put in handcuffs is abuse?
I guess every criminal who has ever been arrested will go free now.

Evansville, Indiana?

I live about 6 miles from Evansville, Wisconsin. My first thought was, “Oh, those crazy inbred dopers in Evansville are at it again!”

I guess it’s the same the world over, LOL!

Yes—I would definitely say that putting a child in handcuffs for 4 or 5 hours is child abuse. I don’t think the same rules apply to children that apply to criminals, but maybe that’s just me...........

I would be concerned about safety, as in a fire or something, particularly since the mom fell asleep.

Were I on a jury, I’d consider whether the child was subject to danger. As long as she was rescuable and not suffering any permanent damage, I don’t think I’d call it abuse sufficient to remove a child from the home.

Yup — it sure is if they are put on improperly. And even if they are put on correctly, four-to-five hours is more than twice the recommended max. There’s a good risk of permanent nerve damage in this case, I’d reckon.

Handcuffs aren’t toys: they are weapons.

Handcuffs aren’t toys: they are weapons.

Handcuffs are no more a weapon than a pointy stick or piece of rope.

They're not legally classified as a weapon anywhere in the US that I'm aware of. I suppose you could clunk someone in the head with them, thereby using them as a weapon.

But to flat out call them a 'weapon' is silly my friend.

I would also consider, as a jurist, whether there was drug abuse in the home. It sure looks like it from the photo, but of course I’d need evidence.

It does seem more likely that she had passed out. If she was asleep, it seems that the girl could have roused her enough to unlock the cuffs.

Handcuffing someone is considered a use-of-force. Handcuffs, as a weapon, render your opponent temporarily disabled for as long as the handcuffs are applied (conceptually, a little bit like a Taser does). Used improperly they can cause lacerations, loss of circulation, tendon damage, permanent nerve damage and severe pain.

Of course they are weapons.

I’m not completely familiar with the US situation as it varies from state-to-state. I do know that in some states you are not permitted to use handcuffs without proper training and licensing. In Australia you aren’t permitted to possess them without a licence. (In NZ you can, paradoxically — our laws are often stronger than in Oz).

Or you could fasten them really, REALLY tight onto your perpetrator’s wrists, leave the double-lock off and wait a few minutes while his hands turn first purple and then black...

You can certainly easily injure someone by handcuffing them. Given that context, in what way are they *not* a weapon?

Weapons? That is obviously an uneducated assertion. I have personally transported prisoners long distances in cuffs and shackles for 24 hours at a time. They had neither permanent nerve damage nor did they have any bruises or other damage that you could see.

I have extradited prisoners out of most states in the US, and they all wore the jewelry for way more than 4-5 hours with no damage. How do you suppose they transport the prisoners with the black boxes? eh? Some of those guys ride that bus for up to 36 hours at a time.

Handcuffs are considered a ‘restraint’.

Not a weapon.

Can still do damage, nonetheless.

I keep forgetting that diehard is a Kiwi. Their ways are all different down there. Restraint yes. And if you get an idiot that tries to fight them, then yes, they can become agressive. But applied properly and double locked, they do not cause damage. I transported a couple wise guys clear across the country by myself, and I double cuffed them with inflexible cuffs. They lived.

You want something that can get painful, try a pair of Smith and Wesson Leg Irons. As long as you sit still they dont bother a bit, but you try to run in them and they really bite, but then they are designed that way intentionally. I only had to chase one guy down that was wearing my leg irons.

For what its worth.

Disclaimer: I am not a parent. I would like to be, but time is running out and at this point it doesn't seem likely.

I have always wondered about these stories. Tying up the daughter...locking them in the basement...handcuffs. I always wondered how/why any parent would do such a thing.

Fast forward to this past weekend.

The wife and I don't get out much. At least not out in public. I mean we go to church and shopping and work and such, but we don't go to bars or concerts or other "wild places". Well this past weekend we were given the opportunity to sell our cheesecakes, (small home business gaining speed) at a nearby town "festival". We spent the weekend serving up cheesecake, (the new KeyLime went over very well), and watching the world go by.

Oh My!! We saw young girls, 12-16 roaming the fair showing twice as much skin as was covered. Sports Illustrated and Victoria's Secret models wear more cloth. If you took pictures and tried to have them developed, the police would be knocking at your door. I swear that if some of them coughed everything would be bare for the world to see. And I wonder, "where are these girls parents?" Well now I know the answer. They are at home afraid of being arrested for using handcuffs or locking them up in the basement or......
