No he can't; no civilian court has jurisdiction to collaterally attack a decision of a court martial.

If Kalid Sheik Mohammed can get a trial in civilian court ... why not Mr. Lakin?Mohammed is scheduled to have a criminal trial in a civilian court. If he is convicted in that case, he will not be able to bring a civil suit "for fraud and damages."

She said opening up such evidence could be an “embarrassment” to the president and anyway, it should be Congress that would call for impeachment of a sitting president.

The only one would be nazi pelosi who certified his vetting. She COULD be charged with submitting a false statement. But again she would have multiple defenses. Conviction highly unlikely

This is a stupid challenge. Power is inherent to the people via the Constitution, as it is a compact of “We the People.” Nothing limits that power from existing within persons in the Army. After all, it is the People after all who provide for the common defence, also per the Constitution.

The test: would this order to LTC Lakin to deploy to the Middle East exist if it did not originally come from Obama or his Secretary of Defense? Actually yes. Obama is not relevant to this case. I make that statement in light of how the judge ruled today. When you find a judge who agrees with your opinion, we can have a discussion.

When I said the people who work in government will be the ones who would ultimately remove Obama from office also included the people who serve to protect and enforce the laws of this nation as in law enforcement and the prosecutors

I should have known I was wrong when I thought something you posted made sense : )

So, having apparently dispaired of litigating BO out of office, you now plan to have the Chief Executive deposed by the Exeutive Branch. Interesting. Care to share your thoughts on the mechanics of how that will done?

As much as I would like to see him leave / be removed it wont happen by this congress or even the next. The reason is this. With poll numbers the way that they are being so low in favor of both parties, they would be cutting their own throats admitting that they deceived the public and created this problem to begin with. Their poll numbers would be around zero. No confidence in congress would remain at all.
Democrats could not place blame on anyone and republicans would have to show that they were complicate.

What will come of this is that Obama will never run again. he will probably remove himself from office before the end of his term by 6 months or so would be my best guess.

But for anyone in congress to admit that they allowed this to happen would be about the same as slitting their own throats and take everyone down with them in the process. I can’t see it happening in this world can you?

First the war deployment orders come from Obama. You'll also notice that the Secretary of Defense takes that order from Obama (echoes it) by signing the war deployment orders as it says in the article. This same order goes all the way down the chain-of-command to deploy to the E-1 Army private that originally came from Obama.

When this gets to SCOTUS, if they agree to hear it (if they don’t, that’s a whole ‘nother stinking pile of expletive), would there be a mechanism to get Kagin and Sotomayor to recuse themselves?
