First Grader Turns Himself In for Having Toy Gun, Faces Expulsion

Darin left his backpack at a friend's house and had to be sent to school with a backup. When he discovered the toy in the bag, knowing it was illegal, Darin turned the contraband into his teacher.

"He found the toy gun on the outside pocket," Darin's father Chris Simak told local reporters. "He took it straight to the teacher and said that he wasn't allowed to have it."

Darin's teacher followed protocol and brought the first grader to the principal, where he was immediately suspended pending an expulsion hearing. According to the school charter, the punishment for bringing a toy weapon to school is expulsion for "a period of not less than one (1) year."

"He did the right thing, and we're trying to teach him the right way," Simak said, "and now they're teaching him the wrong way."

That reminds me of the video of a father being arrested at a school meeting because he talked over the two minute limit.

Zero tolerance policies are passed so school boards and officials don’t have to suffer the burden of discernment and common sense. The poor child was already sufficiently re-educated to know he was carrying contraband and turn himself in. Now international social media disdain will fall upon the feckless officials, who richly deserve it.

I wonder if the moron principal called the ATF and the FBI so that they could do a midnight raid on the kids house, arrest him and want him to spend the rest of his life in prison. An added bonus for the ATF would be that there was a dog to kill in front of the child, we all know how dangerous a 4 pound dog can be when the ATF is in fear of their lives.

I am NOT defending the teacher, but I cannot help but wonder what could happen to her if she had not reported the toy gun? Most teachers are not mean, but they are under tremendous pressure if they want to keep their jobs. My daughter started college majoring in elementary education; I don’t know what all they told them, but she dropped out of school even though she had a 3.9 GPA.

It’s not madness or idiocy, it is the FACT that otherwise conservative parents are putting their kids into the hands of flaming liberals.

I’ve said in the past and I’ll say it again. Parents need to teach their kids to NEVER trust an adult in authority (at least regarding teachers and social workers). The kids need to understand that they MUST LIE in some cases to prevent being separated from their parents.

In this case, the kid needed to be told (prior) something to the effect that if you have anything you should have at school (maybe an aspirin, or a toy gun, or even a real gun), NEVER tell anyone, just bury it as far down in your backpack as possible and don’t even think about it until you get home.

As I told my kids, when they were younger, if they wanted to complain to others about being spanked, they will get a BRAND NEW set of parents - that simple. If they say ANYTHING negative about mom or dad, same thing, new parents. While that may be an exaggeration now (maybe), it’s likely to be the case in the near future.

Bottom line - KIDS MUST LIE today, because we have way too many flaming liberals that are doing all they can to ruin the lives of kids, especially if they come from what they perceive to be “privileged households”.

If I understand education law correctly, just because a school district expels a student that doesn’t mean they no longer have the responsibility to spend resources to provide for his/her education. In Minnesota, for example, “•The district is responsible to provide the student with alternate education services during the expulsion/exclusion period.”

So, the parents should be able to provide their children an alternate education at state expense.

It would be great in this district if the parents combatted this silly ruling by having ALL the little kids pack a toy gun in their backpacks. Will the school expel EVERYONE?

Then they still have to pay for the education with the taxes you’ve already paid in.

These people are assinine! When I was in grade school here in eastern pennsylvania in the early 50’s, kids used to bring a 22 rifle to school and leave it in the cloak room to hunt after school. Then some liberal got the idea to create GUN FREE SCHOOL ZONES and it started.

I am in Europe right now. There was a kids carnical today. The local police had set up a shooting gallry with NICE air rifles for the kids. Go figure.

I believe it is the institution that is evil, and that the authorities within it are brown-nosing chicken-sh*ts who think that the world owes them a living.

The kid needs to learn that there is following rules and then there is right. The right thing to do was to zip up his backpack and not say a word. Now he’ll be labelled a problem child and have a suspension on his record.

Very good point. It is good to teach kids to obey rules and laws, but it is equally important to teach them common sense and their rights.

Stupid bitch teacher just couldn’t apply a little common sense to the issue could she?

My kid got into trouble a few years back when some boys in class sneaked her purse and started playing with her music. She was at the teacher's desk at the time so the teacher knew she hadn't done anything wrong. However, because of the rule of not playing music, daughter was sent to the office and had her mp3 player held hostage by the principal. Never mind she wasn't the one playing the music and she wasn't the one who was messing with someone else's personal property. I was called in for a conference even though she was allowed to have an mp3 player because she's a bus rider (bus routes here are long). Then I had to pay $5 or $10 ransom to get the mp3 player back - really, excuse me, that's theft and extortion. It was all I could do to keep her off suspension. Of course, the boys got off scot free.
