TERRI'S FIGHT
(Daily Thread 2 - November 1-2, 2003)

Link back to thread 2 - October 30-31)

.

Contained in thread 2:

.

Contact information for the ACLJ, link for Chris Ferrara's legal brief, Senate Amendment to Terri's Bill, Ken Connor of the Family Research Council joins fight for Terri's Law, contact information for law enforcement and Judge Demers, Republic's impassioned letter to Judge Demers, Schiavo's claim that Terri's surgery was a success, link to CBN interview with the Schindlers (Oct 31), state's medical directors come out against Terri's Law, more links to testimony and legal debate, short bio on Judge Demers, update from the vigil and a doctor's exam report on Terri from 1990. Wacky Sam has also graciously offered to provide server space for documents to be kept to prevent their loss form other sources.

There is also a lot of discussion and links dealing with the seeming network of connnections between the girlfriend, Jodi, various insurance business links and possibly Terri's new doctor. In addition, several questions are addressed regarding Michael Schiavo's hiding of assets and tricks that may have been employed to throw off investigative efforts. Some of the FReepers have been doing their homework on the unholy alliances in the case. Let's keep working to connect the dots and expose the results. Also contained in thread 2 is some of Schiavo's litigious history, a bit more information on George Felos and more on Jay Wolfson. Some information on the doctors involved in Terri's case can be found on this thread as well. Since there are so many posts and links to the above mentioned topics, the best thing to do is to browse the thread.

.

Click on pic for Terri's website

This thread serves as a place for posting all new general information and references, along with links following Terri's case, plus information on cable news and talk radio shows dealing with the issue, court cases and press releases. This is also the place to post contact information, prayers and general discussion.

If you have something that qualifies as BREAKING NEWS or FRONT PAGE NEWS, please post it on a separate thread in that category in order to give it maximum exposure and then post a link to the article/thread here so that it will be included in the next update of links. Also, if you post links to articles from original sources and there is also a thread on FR, please link to the FR thread. Many original links become corrupt over time and we want to be able to access the information at will.

Thanks again to everyone for all your hard work.

Some of us are probably feeling a little deflated today. When the Florida courts appoint a guardian who is NOT supported by Terri's parents, it just makes us sick. However, I suppose this guardian is not liked by the HINO either, since he wanted to remain in charge of Terri's affairs.

Good news that ACLJ (Jay Sekulow) has jumped in to defend
Terri's rights. The ACLJ has proven itself time and time again to be a champion for the family and pro life. (I sent a first-time ever donation to ACLJ after I heard they were taking the case - and it hurt a little cuz I'm not wealthy.)

I think we all need to just hang in there. Hopefully, the Schindler's will have good exposure on Larry King Live this coming week. We need to pray for a turn-around in public opinion.

I keep reminding myself that this is a spiritual battle and though our numbers seem to be weak, we are strong in our convictions and our faith. (Hint: David and Golliath)

I am so grateful and proud to be associated with FReepers who love and cherish Terri's right to life. God bless us all.

Same here Saundra. And I think, too, of Gideon. God has always used the weak and the "foolish" to confound the wise in the world. I am so thankful that we have the support and the faith of one another to keep us mindful of that.

THIS Jay Wolfson?

February 4, 1994

TAMPA - A secretary at the University of South Florida who says she was injured during a faculty fracas just before Christmas filed a civil suit Thursday against one of the professors involved.

Jay Wolfson, a USF professor and member of the Hillsborough County Hospital Authority, threatened secretary Yolanda Santos, grabbed her and jumped on her back - all in a struggle over Santos' personal tape recorder, the suit charges. (read the rest at http://www.yerridlaw.com/verdict58.cfm)

True Believer sent me this. Can there be any doubt the forces that are involved?

Conservative, Liberal Law Groups Face Off by Steve Jordahl, correspondent

SUMMARY: A legal battle over the role of government in decisions about life and death is under way in Florida.

The American Civil Liberties Union (ACLU) and the American Center for Law and Justice (ACLJ) -- two of the most influential legal societies of their respective ideologies -- will oppose one another in court to determine whether the state of Florida can order Terri Schiavo to be fed and given water.

The case stems from the Florida Legislature's passage last week of a law allowing Gov. Jeb Bush to stop the court-ordered starvation and dehydration of Schiavo, a 39-year-old disabled woman.

The ACLU quickly filed a suit challenging "Terri's Law" as unconstitutional.

"This is a dangerous abuse of power by the governor and the Florida lawmakers, and it should concern everyone," ACLU spokeswoman Alessandra Soler Meetze said. "It's an extremely frightening prospect when the governor negates a court decision . . . simply because he disagrees with the outcome."

The ACLJ joined the legal battle this week; Chief Counsel Jay Sekulow will argue that there is ample precedent for the governor's involvement.

"The Legislature has a role to play here," he explained. "The courts are not the sole and only arbiter of life-and-death decisions. What's interesting here is that the governor of each of the 50 states -- including the governor of Florida -- has the authority to issue a stay when it comes to someone on death row."

This case could have a significant impact on the right-to-life debate in Florida -- and beyond.

"The scope of this case is well beyond Terri Schindler-Schiavo's life, although that is obviously very significant," Sekulow explained. "It involves the whole role of what the legislative process is concerning life-and-death matters."

The trial should begin by the middle of November.

FOR MORE INFORMATION: Dr. James Dobson and a panel of guests discussed the legal and moral implications of the Schiavo case during a recent "Focus on the Family" daily radio broadcast.

Family.org

"This is a dangerous abuse of power by the governor and the Florida lawmakers, and it should concern everyone,"

It's a dangerous abuse of power alright, but it isn't the lawmakers and the governor who are abusing it.

How do you think we should go about checking to see if there was insider trading around the same time that Jerger Insurance being taken over by Philadelphia Consolidated?

And shortly before that, Jerger took over a company run by Steve Beaty...how could we find out if there was insider trading on that?

Or are those types of takeovers done in a way that there would have been no insider trading?

I'm not saying that anyone we've mentioned here on FR was involved in "insider trading" (whatever that is), I'm just asking a general question about persons unknown.

Florida Trend, Sept 2000 v43 i5 p16

Beaty, 41, started as an industry outsider with his own company, Micro Business Systems, providing software to independent agents. For Pinellas Park-based The Jerger Co., he developed a pioneering program that allowed it to quickly identify mobile homes by ZIP code and park. Thus, it could grow into the largest independent mobile home insurer in the Southeast, even as it spread its risk so that a single tornado didn't mean catastrophe for Jerger. In 1986, he sold Micro to Jerger and became its chief information officer. When Jerger was sold this year, Beaty jumped to Bankers.
The Jerger Insurance subsidiaries gained Philadelphia Consolidated's A+ rating in after they were bought in 1999.

You're asking the wrong person. I am not well versed on business or economic matters. When it comes to such things, I go strictly by the "economics for idiots" version. But it certainly does look as if there are questionable (to say the least) ties between a number of the players, from the hospice, to the doctors, to the insurance, to the mistress, to George Felos, to the Judges. I hope these unholy alliances will be exposed. It is looking more and more as if Terri is nothing more than a pawn in a huge, sick chess game.

I will defer to those FReepers who are more knowledgeable in this area. There are plenty.

Photo Exclusive...

The Schindlers hold a press conference showing a videotape of Terri interacting and being responsive. Pops Schindler was worried that he would be held in Contempt of Court for making the videotape public. Much to everyone's surprise, Michael Schiavo briefly took away the Schindler's visitation privileges instead.

Is this current? The HINO has taken away their visiting privileges AGAIN??? How can anybody not see what a control freak creep Michael Schiavo is?? What kind of man punishes a mother and father for trying to save their child's life? Oh yeah, the same kind of man who would terminate a disabled woman because she became too inconvenient and expensive.

The photo is from a press conference that occurred the first week of the Vigil. Visitation was restored the next day but just another example of the mental anguish hubby and his attorney have put the family through. Now I'd like to re-print this from yesterday's thread. It's important as to what the Schindler Family's needs are in real time.

Please ping your lists to this post. FAMILY FRIENDS MEMO TO TERRI'S SUPPORTERS:

10/31/2003, All Hallows' Eve, Evening Prayer Vigils Resume

As you know, Mr. Schindler profoundly believes that as a result of your prayers, Terri is still with us today. Currently, legal proceedings have begun for Mr. and Mrs. Schindlers' fight for guardianship of Terri. In addition, the Schindlers are fighting Attorney George Felos' attempt to challenge the constitutionality of Terri's Law. The American Center for Law and Justice is joining the Schindler family and their local attorney in this regard and wish to uphold Terri's Law. We are very encouraged by this!

Many calls have been received by the public asking, "What is going on now?" and "What can we do?" Prayer is the most powerful weapon we have in the battle for Terri's life. Please continue to pray, and if you are able, visit the site of the vigil once again. Many of us are peacefully lighting candles at dusk Friday, Saturday, and Sunday evenings each week to pray for both Terri's healing and for her protection. This prayer has given this fight for Terri's life the momentum it gravely needed. We are asking for your perpetual support. Please tell all your friends, church members, prayer groups, sports teams, class mates, and families that we need your help. Terri cannot speak for herself yet and it seems that the siege is just beginning after thirteen long years.

The location of the hospice vigils is 6774 102nd Avenue North, Pinellas Park, Florida.

Mr. and Mrs. Schindler will be on Larry King next Thursday. We don't believe the official release has been given on this, but stay tuned for further updates. This is the best information we have at this point.

On behalf of Terri and her family, thank you and God bless you.

Many blessings, Friends of Terri

I want to post this resource here for those of you needing ammo about removing feeding tubes from patients.

Denying patients food or water with intent to kill them is wrong

"By including artificially provided food and fluids within the category of treatment that a competent adult may decline, the 1992 Washington State Legislature passed a law that put food and fluids within the category of medical treatment that a legal guardian or surrogate may decline for incompetent patients who have not "executed an advance directive," or legally told the doctors how they want to be treated at the end of their life."

Please note in the above the absence of a requirement that the patient left instructions. Your state may also have a similar law in effect. Check with your local pro-life group.

The link also has an impressive list of symptoms experienced by those who are dehydrated to death. Do share when you have the chance. :-)

Link to Bio On Judge Demers
http://public.fotki.com/Budge/terri/david_demerrs.html

Link to Jay Wolfson
http://hsc.usf.edu/publichealth/eoh/jwolfson/

It appears they are both professors at Stenson Law School.

And as stated in my previous posts Jay Wolfson is NOT an M.D.
He has masters Degree In Public Health, the "Administration" of Health

B.A., History,University of Illinois, Chicago 1973
M.A., History, New York University, 1974
M.P.H., Community Health Administration,
Indiana University, Bloomington 1975
Dr. P.H., Health Services Organizations,
University of Texas, Houston 1981
J.D., Law, Stetson University College of Law 1993

I would not want to go to Jay with a sprained ankle for a diagnosis, much less a life or death determination if someone can ever swallow again, or be re-habilitated. Anyway WHY does she have to "improve" to live? Isn't living on any level a basic human right? For crying out loud the guy isn't even an M.D.

The judge knew him, no doubt he knows his beliefs as well so that is why he was picked.

From Jay Wolfson's web site
he authored:

The Dangerous Financial Politics of AIDS Protease Inhibitor "Cocktails"

Journal of Health Care Finance
Fall 1997

Wish I could find that article! The title is very suggestive of it being "Dangerous" Financially to give drugs to aids patients. Wonder if it says, form a "Policy" perspective we are better off to not treat them and let them die? This is a giant leap on my part, however the title of his article doesn't sound positive to me if I were an aids an aids patient.

Generally you can sumamrize that the Public Health professionals always look to get the msot bang for the buck. They only have so much "Public" dollars to spend so they would rather spend XX dollars on vacinations for thousands than spend XX on sustaining high healthcare expense individuals. This has been my experience having been around Public Health Professionals for all of my life. The policy wonks and Administrators, [Not the M.D.'s who take the Hippocratic Oath, and nurses who are involved in direct patient care] they always tend to focus on saving $$ and limiting healthcare to some in order to benefit more people. It is typically ther job to manage the budget.

Read and follow the directions below first.

Under the photo is a link: "Get Origional Uploaded Photo" click that.

Once the larger photo loads and it still isn't large enough to read, move your mouse totally off of the photo, then back on. A short "menu bar" will appear in the top left corner of the photo, and in the bottom right corner an "enlarge icon" will appear. Great work on this thread everybody! Took me three hours to read through and catch up. My not-for-profit accountant friend and I did some basic looking at the HFS (Hospice of the Florida Suncoast) 990 returns and he will look at all dating back to '97. His initial reaction was that their financial reporting was 'creative'.

He's zeroing in on their mission statement and how that relates to their dealings RE software program development, etc. they use to 'fund' their for-profit business. Also that a great deal of their funding is via Medicare and how that ties into the whole deal. He was using 'accountant-speak' which, of course makes a normal person's head ache :-) Don't know that he'll find anything that's not already been revealed in the various lawsuits, but it's worth a try.

All HFS info is posted here. This excellent work is by the Hospice Patients Alliance, whose representative has been in touch with me. A quote from his email to me:

"What I do you cannot do; but what you do, I cannot do. The needs are great, and none of us, including me, ever do great things. But we can all do small things, with great love, and together we can do something wonderful." - Mother Teresa

I certainly agree. This has to be kept in the national spotlight.

I emailed an editor last week about that "persistant vegetable state" that they keep printing.
I told him he needs to get his reporters to do some digging because what he was printing was not the truth and he was doing his readers and the community a disservice by printing it.

If we continually contact them perhaps they'll get it right because I'm really tired of seeing and hearing it.

If they can't get it right, we'll just have to keep after them until they do.

The poor sheeple who don't know any better are believing this garbage.

World's oldest person, 116, dies in Japan.

I just wonder if her 90+ year old kids were taking care of her! :)

This woman never would have made to 116 had she been under Michael Schiavo's guardianship.

Unless there was a financial incentive to keep her alive in that case!

Once again the FL judiciary is proving that it is corrupt, but too few to mention even seem to care. I bet most people in FL know nothing about their judicial corruption.

[ Mrs Hongo was regarded as a national treasure in a country where the elderly are revered. On her birthday on September 16, there was a steady stream of visitors to the home of her daughter, 79-year-old Shizue Kurauchi, who cared for her.
Japan, which has more than 20,000 centenarians, recently farewelled the world's oldest man, Yukichi Chuganji, who died in his sleep aged 114. ]

No, Wolfson is not taking the guardianship from Schiavo. He is merely a court "advocate" and appears to be an advocate for Schiavo, not for Terri. This judge knew all this when he made the selection. It's part of FL's "good-ol' boy" network. I wonder if Wolfson and Demers have connections with Senator Graham.

Another possibility we face is that George W. Greer may jail Mr. Schindler for contempt of court because Schindler circulated the "banned" video of Terri. Thus far, George W. Greer has been strangely silent. Perhaps he is plotting his legal comeback to Bush and the legislature. At any rate, do not interpret his quiet status as good news.

Last week I picked up a the Nov. issue of Readers Digest and was reading it. In it was an article about America's worst judges. I only remember three being mentioned but one was a Judge Cope from Clearwater, Florida.

Wouldn't ya know.

Jay Wolfson, a USF professor and member of the Hillsborough County Hospital Authority, threatened secretary Yolanda Santos, grabbed her and jumped on her back - all in a struggle over Santos' personal tape recorder, the suit charges.

Same guy. We've had this up a couple times. She recorded something and he wanted the tape. This shows he loses his temper and had something to hide, perhaps.

Budge, I couldn't find a link under the photo that said "Get Origional Uploaded Photo". Don't know if it's just me or what.

I really appreciate you putting them up though. :-)
