County Prosecutor David Yost, the board's legal adviser, said he was pleased that Common Pleas Judge W. Duncan Whitney granted the temporary order. The board is seeking a permanent injunction to quash the recount request . . .
In the Delaware County case, the elections board wants to block a recount both before and after certification.
"To ask taxpayers to fund someone's political hobbyhorse when there's no possible chance of a different outcome seems to be an utter waste," Yost said. "There's better uses for that money in Delaware County and, I suspect, in other places around the state."
Yost couldn't immediately estimate the cost of a recount in the county, but said it would be "substantial."
This is the latest ingredient in a thickening legal soup.
Delaware County is apparently the first county to seek a court order blocking a recount, said Carlo LoParo, spokesman for Secretary of State J. Kenneth Blackwell. Other counties, however, are thinking about it, he said.
Keith Cunningham, director of the Allen County Board of Elections and incoming president of the Ohio Association of Elections Officials, said he might mobilize other counties to resist a recount, the Associated Press reported.

I think it's clear that Nader won the election. (sarc)
Hopefully, Ohio will change their recount accessibility laws to prevent such frivolous actions in the future...
We seem to be seeing a lot of "sane judge" stories lately. It's about time!
See BS Anchorperson Dan Rather reports that George W. Bush may have been re-elected!.....
I hope someone shows a video of David Cobb when he is told his campaign is a "hobbyhorse". He can go from zero to postal in two seconds.
Am I the only one who thinks that Kerry is behind the Green/Libertarian recount effort in Ohio?
Good! Glad to hear it..
Still about twice the time that Dean [and Lawrence O'Donnell] can do it in.
I agree.
I think that a recount should definitely be in the works IF the race were close.
However, it's not close and no amount of tin-hat, black helicopters paranoia from the whacko left and whacko right will change those numbers.
This whole recount effort is someone's political hobby horse and they should have to pay for it too!
All of it!
No.
Yes, but precenent is still important.
the current exercises in overcoming law are about setting favorable precenent
Dems are fixated on this provisional ballot concept. They need recounts to understand, going forward, how to cheat more effectively using provisional to stuff ballot boxes. Maximize cheating, while reducing risk of indictment for votor fraud. But, they won't spend their own $'s , but taxpayer's, to get the analysis they need.

He's merely awaiting the faxed documents for confirmation...
Delaware County is solid Bush Country. It is the county immediately north of Columbus. It has seen a lot of growth. One of the big reasons Franklin County is now Democrat is Delaware County's growth.
I doubt that Delaware County will be the last county in the state to file something like this. I saw some place where the folks in Allen County (Lima) are not very happy about this potential recount. The Allen County folks said they were in the process of talking with other counties.
Someone on another thread said they heard on Hannity's radio show that Kerry-Edwards had lawyers "join in" the suit yesterday. Wonder what that exactly means--is Kerry now willing to throw away any political capital he has (for 2008) and demand a recount himself instead of hiding behind these fringe groups, OR, is his tactic to try to overturn the results by pretending to be doing this for the greenies and libertarians, who of course have NO CHANCE of winning the state in a recount.
What about a recount in NH and WI, two states Skerry won that were as close or closer than OH. Fraud rich WI was the state in 2000 where cigarettes were traded for votes.
Who here thinks that the DUs who contributed money to this fantasy exercise will get it back?
I think Kerry desperately wants to be in it and may indeed be behind it. I suspect he will have no party backing to really create a stink, though. In a way, the real power of the party got exactly what they wanted, 2008 preserved for Spawnette o'Satan. There's also the fact that a loud stink could truly be the death knell of the Democrat party as it currently exists. I don't think the country will tolerate another GoreShow at this point, especially after it's already done except for the "signing of the papers."
MM
If we had any real investigative journalists in this country who were not blinded by their partisanship, they would "follow the money" on this.
In the whole scheme of things, it really matters if Bush won the state by 136,789 votes or 135,217 votes....

But John Kerry said all the votes will be counted.
Regardless of the outcome of this election, once all the votes are counted -- and they will be counted -- we will continue to challenge this administration. This is not a time for Democrats to retreat and accommodate extremists on critical principles -- it is a time to stand firm.
You forgot Licking and Fairfield counties too man!! and to a lesser extent Pickaway as well....
But seeing that Columbus and Franklin county were much closer this time around than last, Kerry's people had to know they were in for a long night this time around...
A judge making a decision based on cost an unlikely outcomes ? no way is he a liberal.
No, you are not alone. I have long thought the same thing. In fact I would bet that hanoi john is behind the effort.
Exactly. Unlike 2000, this time around it would be very unseemly and awkward, to say the least. W won the popular vote by millions, his margin of victory in OH is substantial, he's the incumbent, we are at war, plus the general public DOES NOT want to go through another FL nightmare, just the thought of something similar happening again is enough to give most people cold sweats
Plus, right now W's approval rating is in the mid-50's. That, and all the other factors combined, are a deterrent to most mainstream democrats to create a big stink.
I just trolled over at DU--they're a mess! What fun.
If he is, he'll have to go public or else forego the recount.
"Listed you two bit traitor you had your chance, give it up, the public is through with you".
"Am I the only one who thinks that Kerry is behind the Green/Libertarian recount effort in Ohio?"
No, this place is full of tin foil hat folks. However I must say that if you want to view thousands of tin foil hats people in their full glory, wander over to DU. Karl Rove, John Kerry and the MSM are working together to screw America.
And if he does, looks like I'll have to dust off my Sore Loserman signs and head on over to OH :-)
Thinking that hanoi john is behind the recount effort, is not a tin foil excercise.
Yeah! and the election was stolen from Nader by the Evil Republicans, Bush, Cheney, Halliburton and all the dark forces in the universe including Darth Vader and his Emperor. (end of sarcasm)

Here is the deal. Judges know that Bush won, Kerry lost. They know that the president makes judicial appointments, therefore they are lobbying for the promotions by making sane judgments. :)
Rather rumoured to call Ohio for Bush.
Oddy his judge is a clinton appointment.
Kinda hoping they get their way and recount and find Kerry won. Be nice to bring on the civil war now while my kids are young.
He's good at this.
Is Olbermann upset?
He wants only a recount over Demoncrap votes figuring that all the cheating taken by the Demoncrap voters cheated him out of second place.
This is great news!!!!! Badnarik and Cobb can shove it. At least Nader can exploit the cheating by the Democrats in this election.
Badnarik and Cobb.
Of course, SKerry won PA by a closer margin and we all know the fraud in that state.
Let Mrs Ketchup pay for it.
I'm sure you're not the only one who thinks that, but I don't believe that Kerry is behind it at all.
Its such a silly effort that it would damage Kerry's reputation among even the vast majority of democrats who do have the realization that they didn't get as many votes this time.
But he can't totally denounce them either, as these wacky democrats are the manpower of their party, so Kerry will have to humour them for a while on this.
