The idea that Bush might nominate Miers to the high court did not spark immediate enthusiasm from one conservative lega scholar, John Eastman of the Claremont Institute.
'If he wants to give her judical experience, why doesn't he nominate her to the Fifth Circut Court of Appeals.?' Eastman is a former Law clerk to Justice Thomas.

'The nomination of Harriet Miers has not rid us of the repugnant situation that a jurist with a clear and distinguished record will not be nominated for higher service. This nomination did not rid us of the apprehension of stealth nominees.' That is certainly one of my biggest concerns. For almost 20 years, no Conservative with a track record has been a safe nominee, no matter how accomplished and honorable they are. It was time to have that fight. Bush flinched.

That is certainly one of my biggest concerns. For almost 20 years, no Conservative with a track record has been a safe nominee, no matter how accomplished and honorable they are. Yep, but there is no problem getting ACLU activists nominated to the highest court in the land. When will the GOP learn to fight?

Ditto. Why?. We all want the same thing. An originalist that will not turn into Souter. Some of us are much more reluctant to trust in an unknown. And why should we have to trust in an unknown?. There are SOOOOO many qualified female judges out there right now. And she is 60 years old.
Why not stack the court for years to come? Is there something wrong with that?. I think W wants the same thing,
but, why go so far to avoid a fight, and give up so many years of potential bench time? I just don't understand the strategery here.

I am sadly in that group, I was hoping for better from GW. He had the perfect opportunity to shore up the base and do the right thing. I have yet to see a real and credible reason to support this person.
