Another Lost Opportunity (New York Times Whines and Cries About Alito Nomination)

The nomination of Samuel Alito Jr. to the Supreme Court raises a lot of questions about the judge's attitudes toward federalism, privacy and civil rights. But it has already answered one big question about President Bush. Anyone wondering whether the almost endless setbacks and embarrassments the White House has suffered over the last year would cause Mr. Bush to fix his style of governing should realize that the answer is: no.

As a political candidate, Mr. Bush had an extremely useful ability to repeat the same few simple themes over and over. As president, he has been cramped by the same habit. The solution to almost every problem seems to be either to rely on a close personal associate or to pander to his right wing. When the first tactic failed to work with the Harriet Miers nomination, Mr. Bush resorted to the second. The Alito nomination has thrilled social conservatives, who regard the judge to be a surefire vote against abortion rights.

Judge Alito is clearly a smart and experienced jurist, with 15 years on the United States Court of Appeals for the Third Circuit. The nominee should be given a serious hearing. The need for a close and careful review of Judge Alito's record is all the more crucial because he will be replacing Justice Sandra Day O'Connor, who has been the swing vote of moderation on so many issues.

The concerns about this particular nominee go beyond his apparent hostility to abortion, which was most graphically demonstrated in 1992 when his court ruled on what became known in the Supreme Court as the Casey decision. Judge Alito was the sole judge on his court who took the extreme position that all of Pennsylvania's limitations on abortion were constitutional, including the outrageous requirement that a woman show that

Hardly extreme. After all the purpose of the provision to give a husband a say in the life of his child. Its not just the wife's baby. It takes TWO people to conceive a child. A fact that seems to be lost on the Left.

Did the Times advocate replacing Harry Blackmun, Republican nominated by Nixon, with a conservative or were they happy when Clinton replaced him with Democrat Breyer?

I'm going to go out on a limb here, but my guess is they were happy with the dem...

My sister is a committed NY leftist, and never fails to read the Times. She always has a rough time during family gatherings - she gets the Times every morning and the rest of us sit and read the NY Post. This kills her. We are so uncouth.

Why would he rely on anyone but his close personal associates? I don't recall Clinton relying on anyone but close, personal associates or pandering to anything other than the left!

And for the record, NYT's: Bush pandered plenty to you leftist pigs. It got him nowhere!

As usual, the NYT attempts to find a prohibition of bad law (assuming, for the sake of argument, that the husband-notification provision was bad law) in the text of the Constitution. The Constitution leaves most matters to the discretion of the state legislatures, and obviously says nothing about abortion, explicitly or implicitly. But the NYT believes that any law that they find objectionable must somehow be unconstitutional, so "penumbras and emanations" must be discovered to strike down the offensive laws. It is typical anti-democratic, Leftist arrogance.

Bush needs to say something like this: "The portrayal by the Democrats of any moral opposition to abortion, or of efforts to regulate abortion by law, as "extremism" are an insult to the millions of Americans of all faiths and no faith who find abortion a morally troubling issue. Up until Roe v. Wade, most states restricted abortion in some manner or other, and these laws were not manifestations of extremism, but of the mainstream reverence for nascent human life that is the hallmark of a civilized society. Of course, in a democracy, opinions will vary even on the most profound moral issues, and people will at different times and places respond to those issues according to their best judgment. And these judgments are best expressed by the people's elected representatives, not dictated once and for all by judicial fiat. In our system of government, the Supreme Court was never intended as the final arbiter of all moral issues, but only of those matters explicitly addressed by the Constitution."

The real lost opportunity is anyone who has invested in NY Slimes stock the last year. The stock of this lying spinning wing of the DNC is falling like it is a Dying Duck with bird flu.
