A US judge has thrown out a lawsuit lodged by New Yorkers seeking the right to dance when they please in their city's bars and restaurants, which is restricted by a decades-old law, officials said.
A group of amateur and professional dancers filed the suit, which bans dancing in establishments without a so-called cabaret licence. The plaintiffs argued their constitutional right to free expression was being undercut.
But judge Michael Stallman rejected their arguments yesterday.
"If these establishments draw more people because they offer dancing, then there is a greater likelihood of pedestrian traffic, increased vehicular traffic and associated noise," he said.
The city said the 1926 law is meant to protect residential areas from excess noise.

Geez louise, no dancing in bars in NYC and no getting drunk in bars in Texas.

If three people start dancing near a jukebox, police can and have shuttered bars. The law is outdated & the issue of cabaret licenses hasn't mattered much in decades, rendering the whole thing silly.

Hey you think that`s bad, you should see the psychos they let roam the street. There was a guy out on parole last year for trying to kill a cop, and what did he do while out on parole? He killed a cop. Just about once a month, if not every week, you`ll read about someone who has a rap sheet as long as your arm who kills somebody, then the usual questions come up "Why was he out on the street?" But hey, at least he wasn`t dancing!
Why do you think Mark Levin, Laura Ingraham-and nearly every other talk show host worth his or her microphone-has spent nearly their entire program focusing on this topic for the past week?
Even Bill Bennett-of all people-has now jumped on the law enforcement, anti-illegal immigration bandwagon.
If that fact alone doesn't tell you that there is a problem-and give you a clue as to its scope-nothing will.

In the abstract, it's not as ridiculous as it sounds.
When you think about the amount of money spent by business owners in order to obtain caberet or liquor licenses it's somewhat logical to expect them to oppose granting carte blanche to everyone who owns a bar or club, which would undercut their profits.
I'm not necessarily saying this is a good law-I happen to disagree with it myself-but there is a seemingly plausible rationale for its existence.
