Riley: Those carrying guns during emergency will be stopped

People carrying guns on the streets of New Orleans during an emergency will be stopped but their gun won’t be taken unless they can’t show that they are lawfully in possession of it, Chief Warren Riley said Thursday night on WWL’s INews cast.

Trying to clear up something that has been the subject of much controversy since Katrina, Riley said that in another emergency situation, officers would check people on the street in possession of guns and will not take the weapons unless they have a criminal record, are mentally ill, or unable to prove they own the weapon.

“They have a right to carry the guns, but they have to prove it is theirs,” said Riley.

Riley also disputed accounts that police had gone into homes and disarmed residents.

Riley said that police did go into homes that had been abandoned or damaged after Katrina and, in the process of looking for survivors, took weapons that he said could be picked up by looters.

According to Riley, the police had 900 weapons in their evidence room and that between 600-700 were turned in by other law enforcement agencies.

How am I supposed to prove that the gun is mine? Should I carry a receipt with me at all times? What if I borrowed it from a friend?

So the police coniscated guns from abandoned homes because they could have been used as weapons.

Did they take th kitchen knives too?

This is beyond ridiculous--this is people's private property. The follow up questions--what have you done to get this private property back into the hands of their owners.

If nothing, that is illegal confiscation.

Total BS! How are you supposed to prove ownership unless it's a pistol you have a carry permit for?

Hell, that's nothing, in New London, CT they take peoples homes whether or not you can prove its yours.

Please clarify.

Are you trying to say that there are states that issue concealed carry permits for specific guns? That would require that those guns be registered.

I thought in most places a concealed carry permit was just that ... and with it you could carry whatever you want that is a legal [note I did not say licensed] weapon, e.g. a sawed off shotgun would not qualify. What states require registration of guns?.

I wonder what action Riley recommends if law-abiding citizens find that their lives and the lives of their families depend upon their firearms, but somehow they are without the proof demanded by Riley. Should a law-abiding person allow himself to be illegally disarmed, putting his family at risk, or should he take some other action?

One might also ask what proof of ownership of firearms is carried by New Orleans law enforcement. I don't recall seeing any firearm serial numbers on a policeman's badge. Shall it be lawful for citizens to disarm policemen who do not provide proof of ownership?

Will the police be disarming each other due to lack of proof of ownership?

When I was in the Army, I carried a military ID, but no proof of firearms ownership. Will Riley be disarming any National Guard troops he encounters? If the President visits the disaster area, what proof of ownership will the Secret Service be required to carry?

Policeman: Let me see your permit and reciept.

Gun Owner: Okay, here you go.

Policeman: Looks, good, everything checks out. We just need to check our records to see if your a felon or crazy.

Gun Owner: No problem.

Policeman: Well, there is a problem. You see, we're in the midst of a natural disaster, and we can't even get ahold of dispatch much less run names against the database.

Gun Owner: That could be a problem.

Policeman: Tell you what, you just give me your gun and you can be on your way. Otherwise you can wait here for a few days while whoever gets the computers working. If they're even still in town.

Gun Owner: Tough choice. Give up my gun or starve to death right here?

Let's see. If you are not prohibited from carrying a gun, such as being a felon or a minor child not in the presence of his/her parent or guardian, then you are in lawful possession. Right? Hell, when I was 12 I was hunting with a 22 all over the woods behind the house. I often walked down the road with the rifle slung over my shoulder.

I believe it works that way in NY or at least NYC. I think some other places as well.

After Katrina they needed many types of medical personnel to volunteer to work in the New Orleans area. I would not go because I could not carry a fire arm that I am legally entitled to carry in the state of Louisiana by reciprocity with the state of Texas. I will help those in need. I will not be a victim.

This is a fantasy on the part of phony tough guys with badges. These cops are more accustomed to wrestling guns away from little old ladies, then they are fighting real men.

My son and his friends from the National Guard, back from combat in Iraq, are not intimidated by little men with badges. My son respects lawful authority. But he and his friends are ready to fight lawlessness, in what ever form or manner it comes.

If a fight is what these lawless cops want, my son and his friends are ready to give it to them. These cops won't be the first men to shoot at them, Nor will these cops be the first men they have killed.

Our sons didn't risk their lives in Iraq to protect our rights, just to have them taken away by fascist punks with badges.

Bring it on.

Typical nanny state BS. Again telling law abiding citizens they must prove a negative.

My guns are 25 years old. I don't have the original receipts. So, am I supposed to "prove" that I don't have a criminal record, or didn't steal my guns? All of this in a lawless, disaster situation where I must protect my family and property? IOW, the state doesn't have to prove I am doing anything wrong, I have to prove I am not?

And I should believe libs when they say I don't need guns to protect myself. From whom, criminals or the government?

i cant believe that if you had a permit to carry in Texas and it was also legal to carry in N.O. and that you were not allowed to carry it there. That is a lot of B.S. I guess they would rather have you mugged or shot than help all of those "wonderful N.O. residents".
