Kind of misses the point. It STILL adds the mental health data to the NICs. Getting relief from disability would end up in the same budgetary dust bin they used to shut down the appeals process for "reformed" felons.

Here's an idea... "Shall not be infringed". If a person is criminal enough, or mentally deranged enough, we'll either lock them up longer or shoot them in self defense.

Nothing else passes the Constitutional "smell test". Or does this legislation magically impart new "mental health" adjudication powers to the list in Art 1 Sect 8?

So wait, now the NRA is saying that because I refuse to negotiate my gun rights away that makes me part of the anti-gun lobby?

Once they start using the ubiquitous "mental health" criterion, at what point will they decide to redifine the term? Who gets to decide who/what's "mental?"

If someone is prescribed xanax as temporary relief of some problem, would that ever be used against that person?

Of course, all this legislation presupposes that simply because someone was adjudicated mentally unstable, that such an one would be unable to purchase a firearm. As anybody who knows anything about guns knows, that's not the case.

States like California will hold someone for 72 hours for most anything 5150 Mental Health hold, and if you challenge your detention they will try to commit you. I have first hand experience. Some illegal gang members were making threats while i was in my yard and when they approached I showed them the 45 in my waist band. I was placed on a mental health hold they tried to commit me, but I was still convicted of Exbiting a deadly weapon and lost my gun rights for 10 years for the misdemeanor. I lost them for 5 years just for the hold. This law is crap and no one will get relief and the abuses will continue. I no longer live in Cali I hated the place from day one, but I am still banned. This law and the rest are crap and need to go.

The scary thing is, even here on FR a solid majority always seems to tbe at the ready to defend the NRA as the only “effective” gun rights organization. Mention GOA and they say “they don’t have any influence”, “what did GOA ever accomplish?”, etc. Maybe if these idiots would stop sending money to the NRA and send it to GOA instead, GOA would be able to get a lot more done. For now, GOA is at least TRYING to get the right things done, which is a heck of a lot more than can be said of the NRA.

The fact is the NRA supported the Bill in its original House version, without most of the "protective" amendments they now tout.

Notice that someone wrongly denied their RKBA, even through bureaucratic inaction, must wait a full year before they can take it to federal court. Better than the existing situation, where if the BATFE did not act on your application for having one's RKBA restored, rather than denying it, you could not go to court at all.

It is absolute BS that you have to petition a court to get your rights back simply cause you had a bad spell. It will take years if you get them back at all.

The NRA for years has tried to de-rail pro-gun stuff in Richmond, Virginia. Basically they were trying to discredit VCDL. I dropped my membership at that point. However, after the crap they tried to pull (and Wayne LaPierre admitted to trying) with the Heller case, I don’t care what happens in the future, the NRA will never get a dime from me or any kind of support. My rights are NOT theirs to compromise away and their attitude and actions offend me greatly. This road they have chosen to travel down will lead to civil war and bloodshed unless they stop and really fight.

ANY kind of gun control is bad for this nation and everyone in it. The NRA is not the gun owners friend and never has been. I know people in ILA who have said the exact same thing. The NRA is a professional lobbying group not a pro-gun group. Their support of the Veterans Disarmament Act proves it.

Oh yeah, just for note, I am not a member of any pro-gun or anti-gun organization. I do however assist with several pro-gun groups that truly do support everyones 2nd Amendment rights.
