Does anyone know if a state controlled militia is legal under the constitution without succession?

The Act prohibits most members of the federal uniformed services (the Army, Air Force, and State National Guard forces when such are called into federal service) from exercising nominally state law enforcement, police, or peace officer powers that maintain “law and order” on non-federal property (states and their counties and municipal divisions) in the former Confederate states.
The statute generally prohibits federal military personnel and units of the National Guard under federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress. The Coast Guard is exempt from the Act.

Has the Constitution ever been anything more than a minor annoyance to these people? I’ve long worried that it will have to be bloodied to be saved. Even more now.

We have this now. It’s called CCW.
Anything is legal under the Constitution if 5 politically appointed judges say it is legal. Conversely, anything is illegal under the Constitution if 5 politically appointed Judges say it is illegal - even the Constitution itself. We have found the real flaw in the Constitution - the assumption that Judges have character and will act with honesty rather than raw political allegiance.
I recall Bush mentioning posse comitatus as the reason why the military wasn’t used immediately after Katrina.
Let’s pray his brownshirts wear blue helmets to make them easy targets.

There are a lot of apologists and rationalizers who think this can't happen in the U. S. of A, but they are mistaken. There is absolutely no other reason to form a force like this for other than totalitarian reasons - simply none!
Above all, this statement of intent by Obama is the worst, by far.
Ironically, the ultimate victims of the last formation of a CDF (Germany), voted en masse for Obama. What is it about the Jewish community that contributes to its own demise?
Talk of a standing army in the US comporting with the Constitution for possible defense from forces without the confines is not the problem. The purpose of Obama’s CDF is not for combating threats from without - it is for oppressing dissent from within.
