Scalia: You need 4 votes for Obama eligibility case

A lawyer lobbying the U.S. Justice Department and the U.S. Supreme Court for a review of Barack Obama's qualifications to be president says a key conservative justice has hinted that another conservative justice has been voting against hearing the dispute.

According to Orly Taitz, a California attorney working through her Defend Our Freedoms Foundation on several cases challenging Obama, said she was presented with an opportunity to ask a question of Supreme Court Justice Antonin Scalia yesterday.

The issue of Obama's eligibility has been raised before the Supreme Court at least four times already but has yet to be given a single hearing. Cases have been brought by Taitz, Philip Berg, Cort Wrotnowski and Leo Donofrio.

when you apply for any job in the USA you have to fill out federal ID form with 2 pieces of identification assuring that you are US citizen.

Where is his forms for his current ‘position’ in the government? Those are public and availabel from FOIA aren’t they?

I am guessing it’s Clarence Thomas who isn’t voting, imho.

"Scalia stated that it would be heard if I can get four people to hear it. He repeated, you need four for the argument. I got a feeling that he was saying that one of these four that call themselves constitutionalists went to the other side," Taitz said.

You only need 4 justices to agree to hear the case to begin with. So Justice Scalia isn't saying anything that isn't common knowledge. I think Taitz is seeing things that aren't there. Again.

A very astute new observation was made in the eligibility thread earlier this morning.

Because Hawaii, it has now been revealed, routinely issued “certificates of live birth” to foreign children born outside of Hawaii, for administrative utility and strictly on the basis of one relative’s filling out a request form— one must wonder that it is a “COLB” that Obama has published online—and not a genuine “birth certificate” that records doctor, hospital and more.

By his putting this type of document online, it seems to make all the more conspicuous his lack of showing a true birth certificate.

Official statements from Hawaii have never stated there is a birth certificate on file that shows Obama as having been born there. Only that a certificate is on file. Notable that the key criterion was left out of any statement.

It appears the sympathetic Obama media has played fast with the truth in claiming otherwise.

Having watched Justice Thomas on that 60-’ show a year or so ago, I find it hard to believe he would stand in the way of justice in America—but wtf do I know, I just go by handshakes and gut feelings vs. smooth-talkin’ devils and rank, titles and other bs.

This is the pat on the head and brushoff. Duh.

Scalia said to Taitz:

“Bring the case, I’ll hear it, I don’t know about others.”

“A very astute new observation “

Hardly “new!” You must be new to this subject. This has been a major part of the argument for months. There was some talk that his half-sister, who was born in Indonesia, had a certificate. But I believe that has been proven to be false. There’s so much written about this case, that it’s hard to keep track of everything.

Another route? Quo Warrento?

>> he DC District Court held that the plaintiffs had no standing other than to bring a “direct attack” in quo warranto to remove the alleged usurper. But the DC Court of Appeals reversed and said the plaintiffs, who had suffered real injuries, could bring such an action on a case by case basis if they could prove their injury in fact (being fired) was caused by a Government official who was not eligible to serve.

They opened the door to a floodgate of litigation by an incredibly large field of possible plaintiffs who might challenge every single official action of the Obama administration on the basis that he isn’t eligible.

- Furthermore, there is a tenet of Government that requires there be a certainty to the official actions taken in the name of the United States. No certainty is possible when millions of US citizens, including active military, are concerned that Obama’s credentials were not verified in the same way all citizens must verify their identity for the most simple things in life like getting a drivers license or passport. ...

Yes, that observation is astute - but it’s certainly not new. I agree, though, that Obama *could* have averted some of these questions had *both sides* of his COLB been scanned (the clerk’s certification and seal markings are allegedly on the back). Seems sort of stupid to NOT show that important part (unless it was added after the questions started flying).

I think that when Obama has made a big enough mess of our country, the folks behind the curtain will trot out the birth certificate issue as a way to get rid of “the one”.

Yes! All of us had to produce a valid birth certificate for entrance into college, transference to a different college and for job applications, etc. Why would the most important job in our nation not require the same? The true answer is scary!

I don’t recall who said this, but this quote was made back during the scandal of Bush’s military records.

“The seriousness of these charges warrants a full investigation.”

I’d say that statement is appropriate in this case as well.

if anything ever comes of this, I’ll eat my hat.

I have NO FAITH in our justice system.
What is so frigging difficult about releasing records and undeniable PROOF that would put all this to rest?

I think you are right.

I think it was Tom Foley - Democrat, then Speaker of the House. From the state of Washington. Defeated in ‘94 by George Nethercutt (R).

No way-he merely explained to her how you get a hearing in any case. Better get ready for 2012 because this is going nowhere.
