Idaho Governor "Butch" Otter has signed into law a measure that would require the state's attorney general to sue congress if the new health care bill passes.
"To protect the people of Idaho, which is one of our first obligation as a government, is the right thing to do," said Governor Otter.
That law is very similar to the Health Care Freedom Amendment Kansas Representative Aaron Jack (R) Andover and a number of other lawmakers are trying to pass in Topeka.
"We just need to make sure the citizens here in Kansas are never forced to be a part of a program," said Jack
The proposed state constitutional amendment says Kansans could not be punished if they do not participate in a government mandated insurance program and Kansans can pay directly for healthcare if they choose.

Thank you, but I was looking for a list of the 37 states considering challenging this farce. Took me awhile, but I found a list of those NOT challenging death care:
“Illinois, North Carolina, New York, Connecticut, Rhode Island, Vermont, Maine and Massachusetts. Also, there are no measures in Montana, Nevada, Oregon and Texas as there are no regular legislative sessions in these states in 2010.”

My state (Oklahoma) has one in the works, too. Unfortunately, that might not help with the military health care part of it—that’s not state, it’s federal.

I don’t know. We will see. One thing is sure; America is hopping mad now. If they pass this the coming weeks will only intensify that as people really find out what it is and how they rammed it through.
No surprise that left wing AG Blumenthal here will not challenge it. We’ll see what happens with a new governor next January.
Good to see Kansas wanting to opt out. That’s the home of Health Secretary Sebelius! Would be quite an embarrassment for her.
States cannot nulify federal laws, that’s been established ever since South Carolina tried it in Andy Jackson’s days. But what this legislation will do is provide a quick path to a Supreme Court decision on the underlying question of whether the government can require people to buy health insurance. If the court rules that it can’t then the whole healthcare scheme falls apart.
I guess the first thing the courts will have to do is place a temporary injunction against the Feds from enforcing the penalties pending the outcome of the lawsuit.
BTW, I’m from the Reformed Amish Community so therefore I’m exempt.
Hopefully Wisconsin’s next Governor & Congress will do it to.
