Retired Air Force Lieutenant General Thomas McInerney has supplied an affidavit in support of Army Lieutenant Colonel Terrence Lakin, who faces trial on October 13-15. The retired Air Force three-star is the highest ranking officer yet to lend public support to LTC Lakin. His affidavit acknowledges widespread concerns over the President's Constitutional eligibility and demands the President release his birth records or the court authorize discovery.
McInerney’s sworn affidavit was filed in Court-Martial in support of Lakin’s motions for subpoenas for all of the president’s school records, and for a deposition of the custodian of Obama’s birth records in the possession of the State of Hawaii. The Judge has set a hearing in the Court Martial on these motions for this coming Thursday, September 2nd at 11:00 at Ft. Meade, Maryland. All court proceedings are open to the public. The courthouse is located within Ft. Meade at 4432 Llewellyn Avenue, which is on the corner of Llewellyn and Ernie Pyle Road. At the first intersection after the Reece Road gate, you should turn left on to Ernie Pyle Road. The courthouse is approximately 1 mile south of the intersection of Reece Road and Ernie Pyle Road.
LTC Lakin is a physician, and is in his 18th year of service in the Army. He is Board Certified in Family Medicine and Occupational and Environmental Medicine. He has been recognized for his outstanding service as a flight surgeon for year-long tours in Honduras, Bosnia and Afghanistan. He was also awarded the Bronze Star for his service in Afghanistan and recognized in 2005 as one of the Army Medical Department’s outstanding flight surgeons. In March of this year, he announced in a video posted on YouTube that he would refuse to obey orders until receiving proof of the President’s eligibility.

Here is a link to the S.O.C. press release announcing that LTC Lakin’s motions for deposition of various Hawaiian officials will be heard of Sep 2 at Ft. Meade.
It also provides excerpts for a declaration for a Retired Air Force–Air Force, not Army–Lieutenant General supporting LTC Lakin’s request for President Obama’s birth records.
Some of the declaration is reprinted on the website, but here is the gist:
If [Pres. Obama] is ineligible under the Constitution to serve in that office that creates a break in the chain of command of such magnitude that its significance can scarcely be imagined.
As a practical example from my background I recall commanding forces that were equipped with nuclear weapons. In my command capacity I was responsible that personnel with access to these weapons had an unwavering and absolute confidence in the unified chain of command, because such confidence was absolutely essential–vital– in the event the use of those weapons was authorized.
I cannot overstate how imperative it is to train such personnel to have confidence in the unified chain of command.

safeguardourconsititution (APF) has an affidavit from LTG T. McInerney in support of LTC Lakin’s discovery request.
Lawyers interested in the legal merits of the issue will likely find themselves dissatisfied with the affidavit. It is a combination of justification for LTC Lakin’s contumacy and reasons why the discovery should be granted.
There is no comment on the general failure of most of the rest of the officer corps in continuing to obey unlawful orders. They have not posted the request or motion in support of any request. Once again failing to give full disclosure.
The affidavit appears to also justify the discovery request as a need for public disclosure.
This would be IMHO an abuse of process. The purpose of discovery in a criminal proceeding is to aid the defense, not to aid public disclosure for disclosures sake.
The affidavit states that the “military MUST have confidence in the Commander in Chief.” There is however no evidence to suggest the military doesn’t, merely some individual members.
Paragraph 4., indicates the affiant’s understanding of why LTC Lakin is wrong.
I have requested the PAO make copies of the motions available on the 2d to those wishing to review or have a copy. That request is “pending” is the best I can say.

“We have to use profiling. And I mean be very serious and harsh about the profiling,” said retired Lt. General Tom McInerney of the U.S. Air Force, suggesting that the United States adopt the profiling guidelines of Israel in order to protect ourselves from an airline attack.
“If you are an 18 to 28-year-old Muslim man then you should be strip searched,” he said. If we don’t do that, we’re going to lose an airliner, he explained.

In April 2008 documents obtained by New York Times reporter David Barstow revealed that McInerney had been recruited as one of over 75 retired military officers involved in the Pentagon military analyst program.
Participants appeared on television and radio news shows as military analysts, and/or penned newspaper op/ed columns. The program was launched in early 2002 by then-Assistant Secretary of Defense for Public Affairs Victoria Clarke. The idea was to recruit “key influentials” to help sell a wary public on “a possible Iraq invasion.”

I agree with him. But we have an administration that won't even call a "terrorist" a TERRORIST! I don't think the General will be invited to the White House.

Oh yes the General has commented as shown below. Because the rest of the officer corps are not following suit does not make the orders that come from Obama as Constitutional and therefore lawful orders. Some people have more courage than others in this matter of conscious. At least two other officers were challenged by their conscious to determine whether Obama was legally the commander-in-chief. LTC Lakin is the one who stepped up to challenge Obama's orders that he believes are unconstitutional and this mil blog argument is a non sequitur.
From McInerney’s affidavit - "LTC Lakin has acted exactly as proper training dictates. That training mandates that he determine in his own conscience that an order is legal before obeying it."
They have not posted the request or motion in support of any request. Once again failing to give full disclosure.

While BHO was bloviating on TV this evening I was playing the recording of Glenn Beck’s program which I had made while the missus and I went out to dinner. But when I would fast-forward through the commercials BHO would come on the screen. There were several instances when I really thought the expression on his face showed angst of some sort; almost as though he was ready to push the Eject button right then. I think the only reason for his speech in the first place was an attempt to change the subject from his BC, and Beck’s Rally on 8-28, etc., etc.
Let’s buy a newspaper add with BO’s picture and multiple paper on his head...

True, until this evening. The excerpts of the speech that were played in the 11:00 P.M. news had Dear Leader actually saying the T word. I think he is DESPERATE to convince people that he is not a muslim; to take our minds off his BC, to get our minds off the shellacking some of his cohorts have taken in recent Primaries, and that are looming in November; etc., etc..
