Man arrested for taking pictures at MIA

STORY

MIAMI INTERNATIONAL AIRPORT (WSVN) -- A man has been arrested after, officials said, he caused a security scare at a South Florida airport.

On Jan. 11, Miami-Dade Police officers stopped Oluwole Aboyade in the Dolphin parking garage at MIA after he reportedly began taking pictures of sensitive areas at the airport.

According to a Miami-Dade Police report, an officer said he became alarmed when he saw Aboyade taking pictures of buildings, surveillance cameras, airport runways and restricted areas. When the police approached the Nigerian national, he said he would remain silent. The police report read, "Mr. Aboyade was observed walking through the terminal and parking garages taking pictures ... upon making contact ... he became very evasive."

"He was approached by several of our uniformed officers who were very alert in seeing what was going on in order to question him and find out exactly why he was there. While questioning him, a lot of things he refused to answer. He was very evasive. He did not want to give any answers whatsoever," Miami-Dade Police Detective Bobby Williams said. "A detective was summoned from that airport bureau there, responded and subsequently, Mr. Aboyade was arrested, because he could not dispel the detective's fear for the safety of people or property."

Police said, Aboyade was in the US illegally. The police report read, "Upon arrival at the station, it was learned that Mr. Aboyade had overstayed his work visa and was wanted by ICE."

My first thought on learning he was a “migrant” is now they’ll roll out the red carpet for him and apologize for thinking he might have had nefarious goals in mind for the airport!

As far as I know it’s still legal to take pictures of anything in public view.
In August I took my wife's sister and her family to JFK airport for their return flight home and I was saying goodbye to them at the security line, as they waited to approach the security gate, and I took a couple of pictures of them waving goodbye and a TSA person yelled at me to put the camera away.

Was she right to do so? I don't know. I didn't question it at the time. I put the camera away.

Here’s this poor, working terrorist just taking the intel pictures Americans won’t take and you gotta make a big deal out of it. Give the poor guy a break.

This guy may be illegal but at least he has a job.

A property owner, or someone working on behalf of the property owner can always tell you to leave. They can make "no picture taking" a condition for staying on the property.

I would always recommend following directions, but if you think your rights have been violated, then take your grievance to a venue designed for the purpose (a call to a supervisor, an attorney, or something similar).

It was the light on the camera. The flash or solid light from a camera blinds the train drivers as they come out of the tunnel.

The Patriot Act makes it a crime to gather information in the furtherance of a terrorist attack. The burden of proof is shifted to the defendant to prove he WAS NOT engaging in such, rather than making the state prove beyond a reasonable doubt that the subject was in fact gathering intel to assist such an act. So what we have HE-AH is a failu-AH to communicate! The patriot Act lowered the level of scrutiny for LAW ENFORCEMENT operations to interdict terror operations on our soil in the name of national security. Remember, too that an international airport isn't just private property it is FEDERAL Property under federal rules, federal jurisdiction and federal rules of criminal procedure. I'm not sure, but I'll bet that local police officers that are assigned duties on airport property have federal authority to detain or arrest under the Patriot Act. While it may not be specified therein, it probably would fall under the necessary and proper clause (aka the elastic clause) under article one, section eight of the Constitution. But that's just a guess.

Unless you’re a member of the Beijing Press Corps, in which case nothing will happen to you. I’ve heard the stories of what goes on when they have Fleet Week in port cities.

Well. . .that just made criminals out of all those tens of thousands of plane spotters. And heck, airshows and picture-taking. . .oh, and Google Maps and Street View?

Seriously, there is no restiction that I know of if you are on public property (or your own property) and take pictures of things in plain view.

Sorry but you are very much mistaken. There are signs on most military bases that prohibit photographing or even drawing pictures of the installation without written permission from the commanding General. Even National Parks place certain restrictions on photography.

Not really.

The signs say certain areas require prior permission and some areas are prohibited for taking photos, but blanket prohibition is simply not there—especially when we are talking about plane spotters off-field taking pictures.
