Definitely worth reading the article. A synopsis:

This guy's estranged wife was in default on her student loans. So the US Department of Education sends a SWAT team to get her. They break into the guy's house, cuff him, put him and his three kids in the back of a cop car for hours while they toss the house.

The questions raised by this include:

So what do we hear from the ACLU on this incident? ((crickets))

I’m curious what a search warrant in a collections case would specify as “the persons or things to be seized.”

Per the 4th Amendment.

We don’t have debtor’s prison anymore, except possibly for the infamous “deadbeat dads.” And, AFAIK, they don’t seize property in student loan cases.

To clarify who the actors here are, the article says:
The Office of the Inspector General has a law enforcement branch of federal agents that carry out search warrants and investigations.

Stockton Police Department said it was asked by federal agents to provide one officer and one patrol car just for a police presence when carrying out the search warrant.

Stockton police did not participate in breaking Wright's door, handcuffing him, or searching his home.

This explains why the federal government took over all student loans.

Pretty sweet deal. Force students who aren't Eric Holder's people to take out loans by overcharging them to fund "scholarships" for students who are Eric Holder's people, then send the non-Eric Holder people to the Gulags when they don't pay up.

This was a well thought-out plan.

The average debt burden taken on by students and parents to get a collage education in 2010 is $34,400.

A lot of recent graduates simply can not find decent jobs and are earning under $30K a year. Starting salaries for college graduates dropped 5% between 2002 and 2007 (inflation adjusted), and are likely to have fallen MUCH further since the economic distress of the last three years.

Today about 70% of college graduates graduate in debt. One in seven student loan holders have defaulted and are in collections. Many are in garnishment, and up to 25% of disposable income may be garnished — although anecdotal reports are heard that claim higher garnishments. The law limits it to 25% but some collectors are aggressive, and the persons in default are shy and beaten.

There are nearly two million young folks who have borrowed for college. One in four is delinquent, but not yet in default.

An graduate in default, is in default because they have a poor paying job. Say $12 an hour — that’s typical. Take home is $10, take away 25% garnishment, and those debt trapped youths are taking home $300 a week.

I am sitting here trying to figure out exactly what merited this Show-Of-Lethal-Force. Did they expect to get in a prolonged gun battle over a school loan? That the victim was going to flush the loan payment stubs down the commode? Did some CI inform the Department of Education that he saw armed men coming in and out at all hours of the night as this was the head quarters for a nation-wide gang of school loan deadbeats?

Or was it much more likely that these goons saw a photo of the woman and hoped that by breaking in at that hour they would find her naked in the bed or shower?

Six hours to ransack the home over a school loan? What on earth were they looking for? Was this a daylight robbery and they were seizing jewelry, cash and electronics to pawn or did they discover a stash of porn and decided to inventory all of it, over and over again?

They won't. They are just following orders and enjoying the opportunity to play with their Delta-team wanna-be toys. A man, someone who thinks, would question himself before going along with this operation. I'm just surprised there isn't a dead pet in the story somewhere.

They won't. That is the scary part. Standard Nuremberg defense was, “I only did what I was told.”

Notice how few people will stand up. We had a pastor who's idea of Sunday evening service was having a “no talent” night for entertainment and he dressed up like Doris Day and sang. NOT ANOTHER MAN WOULD STAND UP WITH ME AS SAY THAT WAS WRONG.

If true...
It was the US DoE. We should all write our representatives and demand an investigation and monitor that process until a satisfactory result occurs.
Also, anyone in the victim’s district should physically attend a very angry protest demonstration at the local PD, the local representative’s office, and anywhere else that the relevant authorities maintain a presence.
Grumbling in cyberspace does not have a marked effect on them. They need to see and hear angry citizens. Lots of them.

On a personal note, I see I’ve written about 13,000 posts. I’m ashamed to realize I have NOT written or phoned or gotten in the faces of that many legislators in the same time period.

The internet is still no substitute for showing up somewhere.

The congress is looking for things to cut. If they don’t have the balls to totally eliminate this useless department they should at least eliminate their police force especially the SWAT team.

I know a guy that is in dispute with the DOE over "school loans" that at the time he swore were grants (regardless). What does the DOE do? They took his tax returns, emptied his savings account and placed a 20% garnishment on his pay with nary a peep of their intentions. Now he gets to pay lawyers to defend himself; if he can save up enough this year to do so.

If he owes, he owes, I'm not defending that. But I think he was subject to straight up oppression by their heavy handed tactics.

Because every damned one of them is a sadistic psychopath who finds brutalizing women and children more potent than Viagra.

Not a single one of these murderous thugs gave a moment's thought about how unconstitutional, how jack-booted, potentially deadly, how anti-American, how Nazi/Stalin/Mao (pick your thug regime) their actions were.

Not a single damned one cared to do even the most basic research to see if their prey was even at the house. Not a single damned one of them cared if there were children in there. They were going to employ extreme deadly force on anything and anyone over a civil liability. They just didn't care about murdering or terrorizing - in fact, I bet they probably were carrying wood for the whole six hours.

After reading years of this crap, I am utterly convinced that every single member of a SWAT team, any SWAT team, no exceptions, are feral psychopaths who are indisputably a clear and present danger to our American way of life.

Stories like this remind me that we have definitely entered into the Kill or Be Killed Era of our existence.

We are turning a generation of college students into indentured servants to the FedGov. Student loan debt cannot be discharged in a bankruptcy, and only the FedGov is issuing student loans now. That first is extremely important, but most students and their families are financially unsophisticated and don’t understand all the ramifications. It is worse than payday loans by a long shot.

According to the video at the link, the DOE denies breaking down the door, denies handcuffing the man, and denies holding him and his children in a poice car against their will.

In the video, the man never mentions his estranged wife, or claims that it is HER loan that is the problem. Something does not add up here.

At some point, people need to start asking themselves whether getting a B.A. in Sociology or Political Science or whathaveyou and being able to tote around a piece of paper from a degree mill is worth it.

At this point, I’m planning on steering my son towards a skilled trade like plumbing or auto mechanics.

As a start, we the People need to start identifying who is participating in these questionable raids, and then publicizing their names in an active shunning campaign.

Sounds crazy, but it just might work to help curtail some of this nonsense. And it is a better step than many other actions that might come down the road.

They are looking to create a system of establishments in which such scofflaws will be held. There they will learn hard, industrious work habits, loyalty to the state, obedience and will learn that the student loans must be there highest financial priorities when they are released from the system (if ever). Activities to help them learn these lessons will include work on roads, forestry work, mining work and manufacturing of goods for sale to the government agencies. They can also shed a few pounds on 700 calories per day. Obama has it all planned out!

Thats a good question, I hope our so called “friends” on the other side who currently hold power will drill into this.
But don't count on it, This is govt. intimidating citizens. They do not fear us, we are fearing them. This is not how the founders set this govt. up. We are in a very scary place here. Judges are giving the ok to this, goons think their delta force, and citizens are treated like trash. History is filled with lessons for govts who get out of control
