Judge: Americans have no right to choose food

A Wisconsin judge has decided – in a fight over families' access to milk from cows they own – that Americans "do not have a fundamental right to consume the milk from their own cow."

The ruling comes from Circuit Court Judge Patrick J. Fiedler in a court fight involving a number of families who owned their own cows, but boarded them on a single farm.

The judge said that's a "dairy farm" and is subject to the rules and regulations of the state of Wisconsin.

"It's always a surprise when a judge says you don't have the fundamental right to consume the foods of your choice," said Pete Kennedy, president of the Farm-to-Consumer Legal Defense Fund, which worked on the case on behalf of the farmers and the owners of the milk-producing cows.

These farmers should take all the milk they can get their hands on and dump it on the courthouse steps daily while chanting for impeachment of this so called judge. Don’t stop until he is forced out.

If I understand things correctly, this is a state law and the state police power that is being discussed. I´m unfamiliar with the relevant state constitution, but it´s entirely possible that the judge is correct.

That doesn´t mean that the law is not ridiculous and paternalistic of course.

Actually the court DID say that the rights of the plaintiffs to own their cow, enter into a contract to board a cow, etc., all of which the plaintiffs claimed to be “fundamental” rights — the term “fundamental” being a key term — are not in fact fundamental rights.

Therefore, in determining the constitutionality of the laws of Wisconsin regulating milk production that the plaintiffs are challenging, the courts will apply a “minimal scrutiny” standard of review.

You could make very similar arguments the plaintiffs are making here about running a marijuana farm or coca field — or even a meth lab — that they have a fundamental right to “grow their own”.

This decision, at least up to the point where the Judge ruled on the question of fundamental rights, which is where I stopped, is NOT activist at all. It is pretty much “turn the crank” legal reasoning.
