The recess appointments President Obama announced Wednesday are “almost certain” to be challenged in court, according to a top official with the nation’s largest business lobby.
The U.S. Chamber of Commerce has not decided whether it will file a legal challenge to the appointments, according to David Hirschmann, who heads the Chamber’s Center for Capital Markets Competitiveness. But he said he’s confident that Obama’s precedent-shattering move will land the administration in court.
"We've made no decisions ourselves," Hirschmann told The Hill. "What we do know is ... it's almost certain ultimately a court will decide if what the president did is legal or not."

Add to that any misconduct from Fast and Furious, corruption from Solyndra and other shady green energy deals, conflict of interest (Obama was awarded a sweet hart deal on Light Squared stock right after Obama pushed the FTC authorization through) in the attempts to sway a Generals Officers testimony regarding the national security and transportation systems because Light Squared’s interference with GPS signals. To compound the conflict of interest Obama refused to place the LS stock into a blind trust when he took office
Add in a Little rezko and you have a slam dunk case for impeachment. Obama has been a busy busy boy driving our country into the ground
Do something besides talk about it... If all you so is talk and threaten, then the result is it's acceptance. Do something or shut up! We are tired of the talk, time to either take these people on or simply shut up and watch.
Although it is distasteful, I will support the president on narrow separation or power grounds.
He has acted in this instance as a president rather than the head moonbat. The Senate stayed in session by parliamentary procedure and is not actually functioning as normal. The reason is said to be to prevent recess appointments. That is a direct challenge on the power of the president by the Senate.
To counter the maneuver the President made an appointment indicating the senate procedure is a sham and the need for the appointment preempts parliamentary games. That is, he is attempting to protect a presidential prerogative that could be forever eliminated. He had no choice but to act in a counter manner. The action also bought political cover but that is another story.
It is widely viewed here as an unconstitutional act and that appears to be the case to me. The result then becomes a matter for resolution by the court. The actions of an improperly appointed officer will be null and void and all salaries and expenses will be required to be refunded to the treasury.
