Justice Sonia Sotomayor's Shocking Ignorance

The liberal Supreme Court justices have demonstrated profound and shocking ignorance of the American health care system. Here's one of the most jarring examples:

"What percentage of the American people who took their son or daughter to an emergency room and that child was turned away because the parent didn't have insurance," asked Sotomayor, "... do you think there's a large percentage of the American population that would stand for the death of that child -- (who) had an allergic reaction and a simple shot would have saved the child?"

I have a precise answer for Justice Sonia Sotomayor.

The percentage of American people who took their son or daughter to an emergency room and were turned away because the parent didn't have insurance is exactly zero.

No person, whether American or not, is ever turned away from an emergency room for lack of health insurance. Ever.

This simply does not happen.

Here's why:

1. It's illegal.

Emergency Medical Treatment and Active Labor Act (EMTALA) is a U.S. Act of Congress passed in 1986 as part of the Consolidated Omnibus Budget Reconciliation Act (COBRA). It requires hospitals to provide care to anyone needing emergency healthcare treatment regardless of citizenship, legal status or ability to pay. There are no reimbursement provisions. Participating hospitals may only transfer or discharge patients needing emergency treatment under their own informed consent, after stabilization, or when their condition requires transfer to a hospital better equipped to administer the treatment.

You can thank Republican President Ronald Reagan for that, for better or for worse.

“We have to vote Obama out of office this year.”

I agree fully (from head to toe) he needs to go. However, replacing Mr. Obama with Mr. Romney, in my opinion, is not much of a change.

The GOP has destroyed any chance of meaningful change in 2012.

No Romney may not be much of a change but it will be a little change. If that is all we can have this election, then I say go for it and hope we will be pleasantly surprised. When I look back on obama v. hillary I wish with all my heart that hillary would have beaten obozo. As much as I despised the clintons she would have been a little better than him. There are those out there who will disagree with me but I am not in favor of letting our country slip into the sewer and then try to pull it out.

Rush's commentary last week on the provincialism of the American left was excellent. Hopefully we will be able to shine more light on the ignorance of the left. Really their only defense is to become more informaed which will utlimately only lead to more of them jumping ship as their entire world philosophy is based on myth.

It's difficult to parse how much they understand. Either they undrstand that their entire position is false and they are pure unadelterated liars or they are the most profoundly ignorant. It's difficult to believe that otherwise functioning adults can steadfastly maintain the liberal position but alas they do.

Even the liberal law academic icon Tribe commented on the blithering stupidity of the “Wise Latina”.

Yet some of our conservative “stars” found her sufficient for the Court of Appeals.

I understand your logic and respect your view. However, in the long term I think it necessary to send a clear signal to the GOP that if they want my “conservative” vote, they will ensure a “conservative” candidate gets the nomination. Obviously, I would never vote for Mr. Obama. However, I will not vote for Romney either. I’m tired of being forced to vote for a candidate I don’t approve of only because he is the nominal “Republican” running in the general election.

In my thinking:

Romney = Obama I stay at home on election day (first time since 1976) or leave that portion of the ballot empty.

I think if more people in the Republican party would admantly declare that....and stick with it. Then we would see a “conservative” actually running as our POTUS choice. We need to “rebel” against our own party.

If that law is constitutional (and most people believe it is), then Obamacare, or something like it, is a necessity.

Why would a SC Justice even ask such a question. Surely they have staff that can do research and find out the answer to simple to find out questions such as this.

Years ago I took my daughter to the E room of the hospital after a home accident. I had insurance.

Ahead of us were some people without insurance. They were taken right in, no charge. I had to pay my deductable right there.

Several years later I visited my kin 500 miles away and my daughter had another accident on a trampoline. I immediately took her to the local E room and when they found I had insurance, they waved the deductible preferring to wait on the insurance and took her in.

No one I know w/o insurance has ever been turned away from an E room.
