Does the Government Have the Ability to Turn All Americans into Criminals?

Posted on 04/22/2012 11:14:23 AM PDT by pinochet

The indictment of George Zimmerman for second degree murder was not based on facts or evidence, but on politics. Even the left-wing lawyer, Alan Dershowitz, accused the prosecutor of "over-charging" Zimmerman, in the hope that he will be frightened into entering a plea bargain for a lesser charge. We are no longer living in the America of Thomas Jefferson and James Madison. Today, the prosecution and conviction of people for crimes is not based on facts and evidence, but on the whims of politicians. This issue goes beyond Mr. Zimmerman, and makes us focus on the much broader question; Is America really the free nation that it once was?

The well known joke that says that a prosecutor can indict a ham sandwich, if he chooses to, is no longer a joke at all. We have so many useless laws on the books, most of which are unconstitutional, that a prosecutor can convict you of something, even if you are totally innocent. The Supreme Court only gets to examine less than 1 percent of the unconstitutional laws, because 9 Judges cannot overturn the hundreds of thousands of such laws that are on the books. Every year, the congress, state legislatures, and city councils, pass thousands of new unconstitutional laws. In addition, civil service bureaucrats at the local, state, and federal level, pass new government regulations that are enforced using judges and police officers.

When Friedrich Hayek wrote "Road to Serfdom" in 1944, he predicted the future of America, which has been transformed from a country of free men to a nation of feudal serfs.

The only way you can avoid breaking one of the many laws in the books, is to stay in bed in the morning. If you tried crossing the street in front of your house, you may be breaking some local, state, or federal law, that you may never have heard about.

Did you really think we want those laws observed? said Dr. Ferris. We want them to be broken. You’d better get it straight that it’s not a bunch of boy scouts you’re up against... We’re after power and we mean it... There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren’t enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt. Now that’s the system, Mr. Reardon, that’s the game, and once you understand it, you’ll be much easier to deal with. (’Atlas Shrugged’ 1957)

Speaking as a Prosecutor of 25 years ... yes absolutely. And shame on anyone that supported the Patriot Act. That one Act has turned our Government into our adversary.

Yes. We are pretty much toast. Ignorance of the law is no excuse. Game, set, and match for our government.

I didn’t support the Patriot Act but I am ashamed that I wasn’t paying closer attention when they passed it. That one sure blew up in our faces.

You had better check into any laws that may be broken by not getting out of bed...

This case actually is very similar to the famous murder case of the “trigger happy” British troops that were represented in their trial by John Adams. They were found not guilty.

There is also the “tyranny of the self righteous” in seeing everyone’s behavior, diet and beliefs other than your own as criminal somehow. Mayor Bloomberg is the obvious example.

IIRC, every politician who voted for it promised it would never be used against up.

I never expected the “Department of Homeland Security” to turn into an American Gestapo Department either. I guess I was too busy thinking about 9/11. Well, 9/11 has been forgotten and is now long gone. However, we’re still stuck with all the crap the politicians pulled on us while we weren’t paying attention.

Under Obama our greatest threat of tyranny is his use of executive orders and regulations that he and his administration can establish by royal edict. The EPA and the NLRB, just for example, have become imperial monsters doing the bidding of his royal lowness.

"Did you really think we want those laws observed? said Dr. Ferris. We want them to be broken..." Upon reading the question, I thought of exactly the same paragraph.

It already has.

“There’s no way to rule innocent men. The only power government has is the power to crack down on criminals. Well, when there aren’t enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws.” —Ayn Rand

And along with that -- this:

Paul Harvey already gave us the Progressive/Obama template for the on-going destruction of America - "If I wanted America to fail"
