Covering all the bases ahead of a momentous Supreme Court ruling, the Obama administration plans to move ahead with major parts of the president's health care law if its most controversial provision does not survive, according to veteran Democrats closely involved with the legislation.

I was hoping at least one Justice would say something about the way it was passed. The bill wasn’t even completed when it was passed....and of course Pelosi’s “you have to pass it to see what’s in it”..has to go down in history as one of the stupidest statements ever......

It’s almost as if they want to find out how much ammunition we really went out and bought.

I am thinking that obamma is projecting to the USSC what he wants, by allowing them to strike down the mandate and a few other exceptions in the bill, but for them to allow him to keep the rest of the bill. He is telling them this so he gets a little victory.

But analysts have said for months, if the mandate is struck down, the whole bill must go. But for obamma to salvage part of the bill, he is telling the judges to take out certain parts that are impossible to survive without the mandate, but keep the rest.

Will the justices follow obamma's orders?

The justices would have to read the entire bill to see what is in it, something Peloski never do, and then do due diligence, something Peloski never did. And this supposed to be responsibility of Congress.

Even had Congress included a severability clause in Obamacare, it would still be proper for SCOTUS to strike down the entire statute if it finds the individual mandate to be unconstitutional, since without the mandate Obamacare can’t possibly work, and it would be impossible for the Court to determine which of the ancillary sections (such as adding funds for healthcare for Indian tribes, etc.) would have been adopted even in the absence of Obamacare. (A severability clause, however, would have directed the Court not to strike down the entire statute had something ancillary, such as the Indian tribe provision I mentioned before, been found unconstitutional.) Let Congress determine which things it wants to keep from Obamacare’s carcass by having it pass those provisions as a separate law.

Obama and his backers never wanted the individual mandate, that was all a ploy to throw opponents off-track, it was a red herring.

What Obama wants is severability because then he gets to keep the Title IX Revenue Provisions which originates a tax on health plans and incomes, allowing for redistribution and increased government control.

Look it up, Title IX of the Act.

Obamacare was never about an ‘individual mandate’; it was always and still is about a massive tax increase on Americans to pay for utopian health benefits and more importantly to allow for increased government control.

If anyone thinks this or what may be the next administration aren’t thinking about a pared down health care plan, I think they’re blind as can be.

Romney has proven himself a person who is sympathetic to fixing the health care system.

Get government out of it. That will fix it in short order. Don’t expect either of these men to do that.

Will the justices follow obamma's orders?

Bigger question is, will the sheeple follow his orders?

I for one WILL NOT!

To do that you need a majority vote of both houses of Congress and the President's signature.
***********************************************

You forgot who you are talking about. He will just do it through executive order, because he has learned that no one will stop him.

You can “fix” things by using free market principles. McCain idea in 2008 was a good idea (endorsed by CATO).

That won't go over so well with all the states...

Romney is “mulling” it over also. He has entirely backed away from “repealing Obamacare”, and today would not deny that he will let it stand until a “longer term plan” is put together...

I missed this. Do you happen to have a link? That way I can print it out and return it with the (tons) of McRomeny/GOP donation requests I get, daily. Thanks.

Who will stop him. He’s been the ‘EDICT CZAR’ since he took office. Lots of braying about it but no action. It just invites more impeachable actions. And he will do whatever he can to muck u things for the next guy.

SCORCHED EARTH is not a policy, it’s a loser’s side tactic and he will use it at every opportunity.

How much more damage in 140 days?(more if you count until 1/20/13)

Don’t let what I said being reasoned and soundly Conservative get in your way.

When neither man supports this, it’s quite evident that I am leading and you would do well to get out of the way.
