Hey Romney Supporters - 51 Votes in the Senate Overturns Obamacare If It's a Tax

Romney's spokesman has said that Obamacare does not impose a tax. But if that's true then it will take 60 votes to get past a Democratic filibuster in the Senate.

On the other hand, if Obamacare does impose a tax, then it will only take 51 votes to overturn Obamacare in the Senate.

This is not some obscure fact. So why on God's green earth would Romney's spokesman being seeking to characterize Obamacare as not imposing a tax? Are they trying to make it harder to overturn Obamacare?

I'd love to get straightforward answers to those questions from Romney supporters.

The way I see it, if it’s not a tax, then the SC just knocked it down. There are no votes needed. It’s unconstitutional as written - period. The SC says that you can’t use the Commerce Clause that way.

I’m wondering if an EO would work at this point, saying that he is upholding the SC’s decision...?

If it’s a tax, we still need to fight it.

If it’s not, then it’s already done and Congress and the President are breaking the law by continuing with the HC’s implementation.

Technically, the 51 really only needs to be 50 + VP.

True, but the way it was passed in the first place was by reconciliation of a bill that started in the House. That only requires a simple majority to pass whatever rules happened to be in effect in the Senate. Even when in the majority, most Senators are reluctant to do away with the filibuster entirely because they realize that they may one day be in the minority again.

Actually, they didn't. They said it was not a tax for the purposes of the Anti-Injunction Act, but it was "enough like a tax" to confer on Congress the power to pass it.

Since this "like a tax" non-tax is not an enumerated power of Congress, there is going to be constant litigation and appeals until the whole mess is repealed.

But your constant chanting of "it's a tax" does not change the reality that it is:

Not an excise
Not an impost
Not a duty
Not apportioned among the several States
and not a tax on incomes

So, it is most certainly not a "tax" that Congress has any authority to pass.

Congress should immediately cut all funding and repeal the law

A repeal bill is an act of legislation.

Congress cannot pass legislation by themselves, bills have to be signed by the President to become law.

Get serious.

It was ruled constitutional by the SCOTUS as a tax and congress can clearly tax us.

Well, Congress can clearly pass excises, duties, and imposts. They can pass direct taxes apportioned among the several States. And they can pass unapportioned direct taxes on incomes, however derived.

Which one is this?

The fact is that this is a penalty by legislative enactment. Which, by the way, is specifically forbidden to Congress by the Constitution.

Watch the Senate pass a resolution that states that 0bamacare is officially ‘a penalty’.

The Senate and the House have already passed, and the President has signed, a LAW that says that already.

Why would they bother to pass a resolution?

Actually, they want the jobs whose lifetime holders are dependent on them, and PPACA creates more Federal jobs for the children of the ruling class than any other law passed by Congress has ever done.

I suspect they want to minimize Obama’s sales pitch; that is good political thinking. It is wise to stop the waves of emotion that drive the liberal voter.

Sadly, I’m seeing more emoting on this forum. Reason suggests only one course of action at present. Focus and get it done.

IT doesn’t matter what Obama, Romney, Reid, Pelosi, or any other politician says now. The Supreme Court ruled it is a tax and that is now the law of the land.

Romney has made it more difficult, if not impossible, to get rid of Obamacare.

With his designation of Obamacare as "not a tax," we stand a better chance of getting rid of it before Romney is elected--even with today's Dem-majority in the Senate. See below.

Now, as a "tax" To "repeal" after 2012 election
"Tax bill" passes in Republican-controlled House "Repeal" passes in Republican-controlled House
"Tax bill" passes in Senate; 51 votes needed** "Repeal" passes in Senate: 60 votes needed***

**It would be easier to convince some Democrats to side with Republicans for a 51 vote majority now, than waiting until after the election and hoping to "repeal" it with 60 votes. (Of course, Obama would never sign it, and it would be impossible to override his veto.) Either way, we're screwed. Thanks, Mr. Romney and your team of incompetents.

Because RomneyCare in MA was the same mold. Mitt is covering his a**. BUT, what really ticked me off was when, this week, that dumba**, Mitch McConnell on national news said undoing ObamaCare was (and this is not an exact quote) near impossible. Saying, "It's easier to stop it before it becomes a Law than undoing it after it becomes a Law."
