'Outraged' judge frees veteran Raub from Virginia psych ward

A former Marine who was forced into a psychiatric ward for anti-government Facebook postings has been freed from the hospital by a Virginia circuit court ruling handed down Thursday.

Judge Allan Sharrett dismissed the case against Brandon Raub, 26, who had been detained by government officials in Richmond, Va., and transferred to a VA hospital in Salem, Va. The judge called the petition to continue Raub's forced detention “so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.”

The actual involuntary commitment was done under VA law. The FBI was involved in the investigation. The real problem is that authorities at all levels felt that the recent shootings gave them cart blanche to not have to produce anything remotely resembling evidence to commit Raub.

When I first found out about this story, I read all of Raub's Facebook comments and felt their had to be something else, such as a threatening email, to warrant this action. When I found out that all the government had was his Facebook posts, to me the action clearly became unwarranted, and thankfully a judge agreed.

I thought the FBI was in on this arrest....

If this is correct, what is the FBI doing enforcing state laws????

If this is not correct, then I will stand corrected

The FBI was in on the investigation and the questioning, but the local cops are the ones who handcuffed Raub and hauled him off to the pscyh ward. All the while saying he wasn't under arrest because he wasn't charged with anything.

The stances taken by the parties involved were downright Orwellian.

Send comments about this to the Rutherford Institute at

staff@rutherford.org and ask that the identities of the specific FBI and local LEOs be revealed for public scrutiny and that they be prosecuted for kidnapping and false imprisonment.

There are more than a few who never, ever see anything wrong with ANY "law enforcement action. "If you hadn't done you wouldn't have anything to worry about." There are four big lessons here: 1) Federal LEOs are getting twitchy; 2) federal LEOs are monitoring through whatever mechanism(s) a lot of personal albeit electronic communications; 3) federal LEOs are monitoring ignorant or indifferent towards Constitutional restrains; 4) not all federal personnel are willing to give carte blanche to an American commissariat. That reveals a LOT of federal deficiencies and weaknesses. Not bad reconnaissance results for one - this time bloodless - incident.

There are more than a few who never, ever see anything wrong with ANY “law enforcement action: “If you hadn’t done you wouldn’t have anything to worry about.”

Good grief...this sounds like the old USSR in action. If you don’t agree with the government, you are judged to be mentally ill and “institutionalized”, a euphemism for “imprisoned”

Agreed.

We have had four statist presidents in a row. However much they may or may not have had real differences on other policies, increasing the scope, scale, ability, and militarization of federal law enforcement has been a seamless work of cooperation and amity.

Whoever is elected in November will do the same. I don’t know whether to be relieved or worried that if it is Romney it will break the string of substance abuser presidents since Clinton.

If there was a fight that FReeper would be summarily executed in his or her home, and the usual chorus here would say “they had it coming when they resisted” and even get off a few witticisms about it, not missing the comedy value and all.

I read the linked account of supposedly heavy-handed over-reaching government behavior - I don’t see any big grievance here - after all, they didn’t shoot Raub’s dog or his mother.

They’re just servants of the People, doing the bidding of the People’s representatives, in patient expectation of a secure and golden pension.
