WI Recall Update: Judge Exonerates Threatening Community Organizer

This Tuesday, in Racine, Wisc., union-endorsed Judge Mark Nielsen found defendant Al Haj Jameel Ghauri “not guilty” of disorderly conduct stemming from events that occurred on June 5, the day of the Wisconsin recall election. Ghauri (pictured above with President Obama), a local community organizer and executive director of the Bray Center in Racine, had been accused of threatening to smash the head of volunteer poll watcher Jennifer Neubauer into the ground for challenging election judges’ issuance of ballots to individuals without proper credentials to vote.

According to Neubauer, whom I interviewed at the polling place shortly after the time of the incident, the police were called and Ghauri was issued a ticket for disorderly conduct. (Disorderly conduct is a municipal, not criminal, code violation, which requires "clear and convincing evidence" for a guilty verdict and not the much higher standard "guilty beyond a reasonable doubt.") Ghauri was then told to leave the polling place.

During Tuesday’s hearing, which initially had been postponed so that Ghauri could attempt to find a witness (he was unsuccessful), Judge Nielsen first informed the courtroom of his connections to Ghauri, whom he had met previously at a political event. The judge and defendant had been introduced by Ghauri’s counsel Patrick Cafferty. Cafferty, along with UAW Local 180, Carpenters Local 161, AFSCME, and the AFL-CIO—all groups which had been leaders in the fight to recall Governor Walker—also happen to be listed as endorsers of Judge Nielsen on his campaign website.

So this judge thinks that the poll watcher's complaint (see video) should be dismissed (despite corroborating witnesses) because she is not of this community and doesn't understand how people talk here. What part of "this is round one, but you won't be around for round two because I'm going to smash your head into the floor" is hard to understand? Read the WHOLE account. This is chilling. Is there no justice in Judge Nielson's court?

Seems she’d have good grounds for a civil suit here. Just like what the Goldmans did to OJ.

IIRC civil suits are heard by a jury, the defendant doesn’t have the option of asking for a judge to decide.

I’m NOT advocating this, I’m just stating an opinion that I am very, very surprised that these activist judges haven’t had bodily harm done upon them. There are a lot of passionate people out there that would be capable of doing severe bodily damage over such rulings.

In a way it makes a good argument that Americans for the most part are very law-abiding.

From reading the article, it seems that this poll was out of control with rowdy voters swearing at the election workers. My advice to poll watchers and election workers — wear a recording device. You’ll capture a lot of boring drivel, but it would be priceless to get these thugs on tape.

It was Racine, not far over the Wisconsin Illinois border. I’m sure those who were hooting and hollering crossed the border and just want to get their vote in. It was common knowledge the fraud that was committed during the recall. 2012 presidential will be 10 times worse and this ruling by this idiot judge will encourage this behavior.

When there is no rule of law, it is up to vigilante justice to take over...it is that simple. People like this need be rooted out. King George thought he did not need abide by the rule of law either, because he was above the law.

At the end of the Rev, those in NY who were Torrey’s were put on ships and sent out of the new country. This was a good example. Guys like this judge would be happy to be in some dictatorship. He should be on the first boat to Haiti or Cuba. He can rule in hell rather than serve here.

When the people no longer can get justice in the court room, when the faith in our legal system is destroyed, there is an open invitation for all parties to get justice by other means. This is just another step in the destruction of our society.

I am absolutely certain that the judge would be equally lenient had someone threatenered to “bash" HIS "head into the floor.” He would - without a doubt - merely find it “imprudent” and not the “unreasonable behavior” necessary for a disorderly conduct conviction.

Yep, that's what he'd do.
